【摘要】 现代社会经济与科技高速发展,随之而来的在司法实践领域中也产生了许多复杂且有争议的案件。虽然刑法理论上不乏对“非法占有目的”的认定,但在立法、司法领域却没有具体规定,造成了对某些财产类犯罪的认定举步维艰。本文将就如何认定“非法占有目的”进行了较为深入的研究。本文分成四个部分:即第一部分是关于“非法占有目的”的内涵。这一部分对“非法占有目的”在国外的研究现状和主要理论,以及我国刑法学界关于“非法占有目的”内涵的论争进行了简要的阐述,从而得出了“非法占有目的”的涵义以及“非法占有目的”的研究对认定成立犯罪,区分此罪与彼罪及定罪量刑具有的关键意义。第二部分是关于“非法占有目的”如何认定的问题。具体论述了我国刑法学界对“非法占有目的”的主要认定方式并指出此种认定方式存在的问题,之后引出本文认为关于“非法占有目的”认定的困境该如何解决的问题,以及在具体的认定过程所要遵循的原则。第三部分是关于“非法占有目的”产生时间的认定问题,在这一部分中,本文首先阐释了“非法占有目的”产生时间的认定对“非法占有目的”具体认定的关键性作用,之后具体分析了现阶段我国对“非法占有目的”产生时间概念研究的不足和缺陷,针对该种不足,本文提出了关于认定“非法占有目的”产生时间参照点的方法,从而更有利于解决对“非法占有目的”产生时间的认定问题。第四部分是关于“非法占有目的”中其他具体要素的认定。在这一部分中,本文首先对“非法占有目的”的“非法”、“排除意思”、“利用意思”三个要素进行了具体分析和认定,其次肯定了对这些具体要素的认定之于“非法占有目的”认定的重要意义,即在具体犯罪中,可以更加明确的区分罪与非罪、此罪与彼罪的界限。更多还原

【Abstract】 In recent years, with the continuous development of social progress, the judicial practice field has produced many complex and controversial cases. Due to the lack of research of "the purpose of illegal possession" in the criminal law and there’s no specific provision in legislation and judicial field, which caused the judicial gets into trouble in some kind of property crimes. Therefore, in this article the author has carried on the thorough research on how to affirm "purpose of illegal possession". The first part is about the connotation of "the purpose of illegal possession". This part of the "purpose of illegal possession" and the research status of abroad and the main theory, as well as our country criminal law educational world about the connotation of the "purpose of illegal possession" in China are briefly described, thus obtained the meaning of "the purpose of illegal possession" and "the purpose of illegal possession" research of that crime, distinguish between this crime and sin and is the key to criteria for the conviction.The second part is about "illegal possession" of how the problems identified.
