职务犯罪案件附条件逮捕制度研究

【摘要】 近年来,涉案金额巨大、人数重大、社会危害性极大的重大职务犯罪案件屡见不鲜,反腐败一直是党和国家的艰巨任务,职务犯罪活动的新趋势对检察机关职务犯罪侦查工作提供了更加严峻的挑战。附条件逮捕制度是2006年在我国司法实践中出现的一种新的刑事逮捕措施。2011年,职务犯罪案件审查逮捕程序进行了改革,将审查批捕权“上提一级”,并且明确提出将附条件逮捕制度扩大适用到职务犯罪领域。附条件逮捕产生于我国的司法实践,具有鲜明的中国特色,是在法定逮捕条件下进行的一种工作机制的创新,有利于优化配置司法资源,实现惩罚犯罪与保障人权的相对平衡。将职务犯罪案件适用附条件逮捕则具有充分的合理性和必要性。职务犯罪适用附条件逮捕制度是该制度设计的应有之意,有利于在遵守刑事诉讼法相关规定的前提下,贯彻“宽严相济”的刑事政策,更好地打击社会危害性严重的职务犯罪活动,维护国家工作人员职务行为的廉洁性和社会公共利益。然而,在实践操作中,附条件逮捕制度规定较为原则性,职务犯罪适用附条件制度没有可以遵循的具体操作规则。职务犯罪审查批捕权“上提一级”后,侦查权在下级检察院,批捕决定权在上级检察院,上下级工作衔接机制和相应的配套协调机制的建立尤为必要。职务犯罪案件适用附条件逮捕制度还存在着诸多需要解决的实际问题。职务犯罪附条件逮捕的操作标准实施状况与检查机关工作人员工作素质密切相关,在完善制度的同时,还应当要求执法者结合职务犯罪案件的特殊情况,进一步增强科学、文明执法的意识,在查办职务犯罪案件中尽量控制使用附条件逮捕,将附条件逮捕制度作为一种补充状态,不随意更改扩大其使用程序和适用条件,以确保职务犯罪附条件逮捕案件的质量和效果,彰显其在新形势下所体现的优越性。本文首先介绍了附条件逮捕制度的产生及发展,对附条件逮捕制度的合法性和优势进行论证,进而阐释职务犯罪案件适用附条件逮捕制度的合理性和必要性,指出附条件逮捕在实践运用中存在的问题,对职务犯罪案件适用附条件逮捕的的程序设计及相关配套机制的合理配置阐述相关看法。在职务犯罪案件附条件逮捕必要性及合理性分析之后,笔者认为,该制度存在以下几点问题:适用范围不明确、配套程序不规范、监督机制不健全。对此,笔者提出以下几点完善意见:从实体要件方面,应综合考察证据要件、罪责要件和必要性要件;从程序规制方面,应当对以下程序严格规范:启动程序、审查决定程序、告知程序、备案程序及跟踪监督程序,依法保障犯罪嫌疑人的合法权利;从监督制衡机制方面,应当建立相应的异议机制、归责机制以及犯罪嫌疑人权利保障机制,以更好地对检察机关附条件逮捕工作进行监督和制衡。
【Abstract】 In recent years, it is often seen the huge amount of money involved, the great number, and great social harmfulness heavy duty crime cases,anti-corruption has been a formidable task of the party and the state, post crime the new trend of duty crime investigation of procuratorial organ work provides the more severe challenges.Conditional Arrest System is a new criminal arrest measure in Chinese judical practice in 2006.In the reform of 2011,the arrest procedure of job-related crime was been upgraded and expanded to the field of job-related crimes.With typical Chinese characteristics, Conditional Arrest system emerged from the judical practice of China and is an innovation of job mechanism in the legal arrest conditions,which helps to optimize the allocation of judicial resources and realize the relative balance of the punishment of crime and the protection of human rights.It is resonable and necessary to apply Conditional Arrest System to job-related crimes.Job-related crimes applicable to conditional arrest system is the proper meaning of the system design and it is conducive to the implementation of the criminal policy of tempering justice with mercy in compliance with the relevant provisions of the criminal procedure law and better combat serious criminal activities,which is also maintain the integrity of civil servants and public interests.However,the conditional arrest system is too general and lacks of the specific operation rules to follow.After the upgrade of Job-related crimes’review of arrest right,the investigative right belongs to the lower Procuratorate and the arrest decision right belongs to the superior Procuratorate.It’s necessary to establish subordinate link mechanism and the corresponding coordination mechanism.There are still many practical issues needed to be solved in the application of conditional arrest system to job-related crimes.The conditions of arrest of duty crime standards implementation work staff is closely related to the quality and inspection organs,In perfecting the system at the same time, also should be special circumstances require law enforcement with the duty crime case,to further enhance the scientific, civilized law enforcement awareness,In handling duty-related criminal cases,using the conditional arrest system as a supplementary condition, do not arbitrarily change the use of the program and the suitable conditions to expand, to ensure the quality and effect of conditions attached duty crime arrest cases, showing its superiority embodied in the new situation.This paper first introduces the generation and development of conditional arrest system,the validity and advantage of the conditional arrest system are demonstrated,and then explain the the necessity and rationality of job-related crime applicable to conditional arrest system, we will point out the the practical problems of Conditional Arrest system and elaborate relate views of the rational allocation of program design and related support mechanisms.After the analysis of rationality and necessity of the conditions attached to the duty crime cases arrest.The author thinks that the system exists the following problems:the scope of application is not clear,matching procedures are not standardized,supervision mechanism is not perfect.To these, the author put forward the following opinions:From the physical requirements,it should be comprehensive study the evidence of guilt and necessity of constitutive requirements;From the procedural regulation, the following procedures should be strictly:sart the program, the audit procedure, informing procedure, procedures for the record and tracking supervision procedure,safeguard the legitimate rights and interests of the criminal suspect;From the supervision and restriction mechanism.In order to better the conditions of the procuratorial organ arrest supervision and checks and balances,it should establish corresponding mechanism, objection responsibility mechanism and the suspect right safeguard mechanism.
