【摘要】 公安信访改革是公安机关践行依法治国方略、推进信访工作法制化的战略部署,是针对现有工作模式和机制的一种变革,是公安机关在信访工作环节实现依法治理的重要途径。沈阳市公安局根据上级政法机关的统一部署,从2013年5月开始,在“诉访分离”、规范信访事项办理、引导信访人逐级有序信访等工作基础之上,进行了大量实践和探索,取得了积极的效果,但同时在思维理念、具体执行、配套机制等方面也存在着一些制约推行的问题,“诉访分离”没有达到预期效果。本文主要是借鉴国内专家学者关于限制信访救助功能的理论观点,参照发达国家关于警察投诉机制变革的参考因素,提出了公安信访改革目标方向的理论观点,并选择沈阳市公安局2015年度信访事项现有全部存量作为资料,访谈了沈阳全市15个区、县(市)公安局信访部门负责人,向600名信访群众发放了调查问卷,对沈阳市公安局信访改革面临的现状进行了全面调查,并采取比较归纳法和实证分析法,通过对数据的研究,分析沈阳市公安局在信访改革推行中存在的问题,采取定性分析法和定量分析法,过对沈阳市公安局信访改革过程中存在的问题根源进行分析,得出解决问题的方案,同时运用实证分析法对方案可行性进行论证,并对后续工作提出具体的合理化建议。本文认为,公安信访改革已经步入轨道,并且不是短期工程。但从沈阳市公安局的实际运行情况看,在受理启动程式、法律导入环节、配套机制的运行、促进目标实现所采取的措施等方面,存在9个阻力性、制约性的问题,当前机制不完全适应沈阳市公安机关信访工作的实际现状,其问题主要源于思维导向模糊、人制化因素取舍、外部环境朔造不利的制约,从根本上解决问题,需要构建以标准操作规程为核心的方案体系,明确信访功能定位、重塑“原初状态”的目标方向、先期打造良好的运行环境。同时,在后续工作中,应从扭转信访政绩观、下移信访改革重心、改善运行机制和外部环境等方面,加强实际操作运行,细化到点,综合整治。更多还原

【Abstract】 Public petition reform is the strategic deployment for public security authorities to practice the rule of law and impetus the legalization of letters and visits. Meanwhile, this transformation of current operation mode and mechanism is a crucial path for petition work to be administrated by law. Since May,2013, in light of deployment from higher judicial authority, the public security bureau in Shenyang has carried out massive practice and exploration in the field of "legal appeal and petition separation", letters and visits management process specification and proper guidance on recursive petition for complainants. During this improvement, issues such as thought, implementation and associated mechanisms restrain "legal appeal and petition separation" from reaching its expected outcome.The material of this paper is drawn on domestic scholars’ viewpoint of limiting petition relief function and advanced experience concerning police compliant mechanism in development countries. The goal and direction of the petition reform of public security authority are projected afterwards. Writer uses all available 2015 letters and visits matter within Shenyang Municipal Public Security Bureau as sample, interviews persons in charge of petition department from 15 districts in Shenyang, and issues 600 questionnaires to letter-writers and visitors. This paper is a comprehensive investigation on the existing problems which Shenyang Public Security Bureau is confronted with. Based on qualitative and quantitative analysis, writer analyzes the current existing problem and discovers the root causes that impede petition reform in the city. The solution is drawn after utilizing empirical analysis to demonstrate the feasibility of the scheme and it can also be a reference for rational proposal for subsequent work.This paper states that the public security reform is not a short-term project and is already on the track. In the on-going operation of Shenyang Municipal Public Security Bureau, there exist 9 blocking factors that limit case acceptance, legal guidance, subsidiary mechanism and the adopted measures. The present system is not fully adapted to the actual situation of petition matters at Shenyang public security bureau. The problem is mainly derived from the indistinct thinking orientation, human choices, and external adverse factors. To solve the problems, we need to build up standard operating procedures as the core of the approach, explicit the function of petition work, remold the goal of "initial state’ of petition work, create a good operating environment in advance. In the meanwhile, we should turn the petition achievements view around, downward move focus of the reform, improve the operating mechanism and the external environment etc. When carrying out the reform, we should not only comprehensively manage the situation but also detail oriented.更多还原
