【摘要】 2013年1月1日正式施行的新刑事诉讼法赋予了检察机关在职务犯罪中应用技术侦查措施的权力,本文围绕技术侦查措施的概念、意义特点及职务犯罪的特点、阐述了检察机关实施技术侦查措施的必要性和可行性,通过分析新刑事诉讼法中关于技术侦查的相关规定,探讨研究了立法和实践中检察机关适用技术侦查措施的实施情况和存在的问题,最后从电信监控、测试检查等具体技术侦查手段着手,深入讨论了检察机关适用技术侦查措施应注意的问题。本文包括了绪论、正文和结语三大部分。绪论对技术侦查的概念、意义、特点和历史沿革进行了简单的介绍。正文由四个部分组成,是本文的主体。正文的第一部分内容为检察机关适用技术侦查措施的必要性和可行性。这一部分在阐明职务犯罪特点的基础上首先从律师法修改给检察机关进行职务犯罪侦查带来的挑战角度及技术侦查对职务犯罪侦查的帮助方面阐述了检察机关采取技术侦查方法的必要性；然后从立法和实践角度阐述了检察机关在职务犯罪侦查中采取技术侦查措施有足够的依据和可行性。第二部分内容为职务犯罪侦查中具体技术手段的运用研究,这一部分分析了职务犯罪侦查中运用电信监控、网络侦查、测谎检查等具体技术手段的相关问题。第三部分为检察机关适用技术侦查手段的立法情况及实践现状。这一部分介绍了新刑事诉讼法关于技术侦查的立法规定,包括技术侦查所获证据材料的使用、技术侦查措施适用期限、条件和范围等问题。同时分析了立法方面的不足,并梳理了目前我国检察机关在实践中适用技术侦查手段的情况。第四部分是关于职务犯罪中运用技术侦查手段的建议和相关立法思考。更多还原

【Abstract】 The new Criminal Procedure Law entered into force on January 1,2013 empowered Procuratorate to apply technical measures in Duty Crime investigation. Based on the concept and significance of technical investigation measures, this paper discusses the features of Duty Crimes and argues about necessity and feasibility of the implementation of technical investigation measures by the Procuratorate. By analyzing the relevant provisions of the technical investigation in the new Criminal Procedure, this paper explores the implementation situation of technical investigation measures by the Procuratorate in legislation and practice and studies the existing problems in application. Finally, focusing on specific technical investigative techniques, such as the telecommunications monitoring, testing and inspection, the paper analyzes the key points should be paid attention when the Procuratorate applies the technical investigation measures.This paper consists of three parts, including introduction, body part and conclusion. Introduction section introduces the concept and significance of the technical investigation, as well as its characteristics and history. The main text is the most important part of this paper, and it consists of four parts.The first part is about the necessity and feasibility of the implementation of technical investigation measures by the Procuratorate. On the basis of the features of Duty Crimes, this part first clarifies the necessity from two perspectives. One is about the challenges coming from the new Lawyers Law, and another is about the facilitation brought by the application of the technical investigation methods by the Procuratorate. Then elaborating from the legislative and practical perspective, this part discusses that application of technical investigation measures in Duty Crime investigation has sufficient basis and feasibility. The second section studies the specific technical measures applied in Duty Crime investigation, including telecommunications monitoring, network investigation, polygraph examination and other specific techniques. The third part describes the legislation status about the implementation of technical investigation measures by the Procuratorate and practice status when the Procuratorate applies the technical investigation measures in practice. This section introduces the specific legislation provisions of the technical investigation in the new Criminal Procedure, including the application of evidence obtained by technical investigation, the applicable period of technical investigation measures, the conditions and scope of such measures, etc. At the same time, the part analyzes the shortcomings of legislation, and clarifies the current situation when the Procuratorate applies the technical investigation measures in practice. The fourth part is about some reflections and legislative suggestions on the improvement of the technical measures applied in Duty Crimes investigation.更多还原
