【摘要】 安全评价制度是安全生产领域一项重要的法律制度,它的施行可以有效地降低安全生产事故率,减少人员伤亡和财产损失。2002年颁布《安全生产法》后,我国安全评价制度体系初步形成。当前我国安全评价制度主要包括安全评价主体制度、安全评价执行制度、安全评价监督制度。本文在对安全评价制度、安全评价制度发展和立法现状做出梳理后,运用文献研究法、比较研究法、实证分析法、规范分析法对安全评价机构法律地位存在缺陷、安全评价机构监管法律机制存在缺陷、安全评价责任追溯制度不健全、安全评价独立性缺乏保障等诸多问题进行了研究,针对这些问题提出了严格安全评价机构资质审核制度、建立诚信体系考核制度、完善责任追溯制度、引入动态安全评价制度、建立动态风险保证金制度、建立安全评价责任险制度、建立政府资金监管账户等法律建议。更多还原

【Abstract】 Risk assessment system is an important legal system in work safety field. It is playing an important role in safety accident prevention, reduce casualties and property losses. After the promulgation of “ Law of the People’s Republic of China on Work Safety”in 2002,the risk assessment system in our country initially formed. Current risk assessment system in our country, including risk assessment main body system,supervision system of risk assessment and the implementation system of risk assessment.After making overview of development of the system of risk assessment and legislative status quo, with the methods of literature research, textual analysis, social investigation and normative analysis, this paper analyzes problems existing in the legal status of risk assessment agencies, supervision system of risk assessment in our country, risk assessment traceability system and legal system protection of independent risk assessment. Put forward legal advice of strict qualification examination system risk assessment agencies, establish the credit system of risk assessment, strict liability system of traceability, introduce dynamic security assessment system, establish dynamic risk margin system, establish risk assessment liability insurance system and set up government regulatory capital account.更多还原
