【摘要】 知识经济全球化大背景下,随着科技的不断发展,国际贸易知识化和知识产权全球化,两者的关系越来越紧密。一国的高技术产品出口已经成为其国际贸易发展新的增长点,其出口伴随着知识产权的保护,已成为高技术产品出口中很重要的话题。知识产权保护是社会经济发展到一定阶段的必然产物,保护知识产权有利于增强出口企业自主技术创新能力、吸引外商投资、创造有序的贸易环境和促进经济社会发展等,在高技术产品出口中发挥着重要保障作用。目前我国高技术产品出口中存在着一些现实问题：出口中三资企业占主导地位说明我国出口企业技术创新能力还比较低；我国高技术产品出口虽然总量逐年增加但主要集中于加工贸易,说明我国出口企业的自主研发能力不强、出口产品的自主知识产权含量低；在知识产权保护方面,我国虽然实施知识产权保护战略但是与发达国家的差距依旧很大,而且面临来自发达国家的贸易纠纷现象越来越多。本文基于以上背景展开知识产权保护对我国高技术产品出口的影响研究,在理论上指出两者之间的关系和知识产权保护对高技术产品出口的影响机理；在实证上用历年数据考察知识产权保护对我国高技术产品出口的影响程度,具有一定的理论和现实意义。本文通过定性和定量相结合的研究方法。首先回顾国内外关于知识产权保护与高技术产品出口的相关研究,对知识产权保护进行概述并进行理论分析,为后面的实证提供理论基础；然后论述两者之间的关系,在此基础上,具体阐述知识产权保护对我国高技术产品出口规模、出口利益、出口结构和出口竞争力这四个方面的影响机制,指出积极和消极的影响表现；分析我国知识产权保护和高技术产品出口的现状和存在问题；其次是对我国31个省份共17年的相关数据进行实证检验,对面板数据模型进行回归结果分析,指出知识产权保护对高技术产品出口的影响程度：最后从国家和出口企业层面提出相关的政策建议。通过理论分析发现知识产权保护和高技术产品出口之间关系密切,主要表现在知识产权保护是高技术产品出口的重要组成部分、是其出口的重要保障、渗透到一国的出口政策中、在高技术产品出口中战略地位不断上升这四个方面；在分析知识产权保护对高技术产品出口的影响机制中,重点抓住知识产权保护影响高技术产品出口规模、出口利益、出口结构和出口竞争力这四个方面,具体问题具体分析：指出对出口规模的影响必须根据本国的实际情况考虑；虽然在短期加强知识产权保护对发达国家的出口利益有利,但是从长期看,也可以保障发展中国家的出口利益；知识产权保护通过提高出口产品的科学技术含量从而对出口产品的结构产生优化作用；通过鼓励出口企业进行技术创新、改善出口环境和减少知识产权纠纷这三个方面来提升高技术产品出口竞争优势。所以,知识产权保护对高技术产品出口在提高出口企业的产权意识、创造有序出口环境、吸引外商投资等方面有着积极的表现,但是不合理的知识产权保护也会产生消极表现,比如导致企业的生产成本增加、限制技术模仿国家的模仿能力、知识产权壁垒逐渐成为新的贸易壁垒等。本文通过对我国31个省份的1997年一2013年面板数据分析知识产权保护对我国高技术产品出口规模的影响程度,选用国内专利授权量来衡量知识产权保护水平,还选取了地区经济发展水平、R&D经费支出、外商投资企业投资总额和全社会固定资产投资这些指数来进行面板回归分析。实证结果显示知识产权保护水平与高技术产品出口相关性很大,知识产权保护水平每提高1%,对我国高技术产品出口规模带动0.596%,对我国高技术产品出口具有促进作用。外商投资企业投资总额和R&D经费支出也对高技术产品出口产生正向影响。我国应积极完善知识产权法律法规、加强培养知识产权人才‘、把知识产权保护上升到国家战略高度、积极参与国际合作等方面加强知识产权保护,促进高技术产品出口更好地发展；对于我国出口企业,主要从加强知识产权保护意识和提高自主创新能力两个方面提高知识产权保护水平,促进高技术产品出口又好又快发展。更多还原

【Abstract】 Under the background of globalization, and with the knowledge-based economy, the continuous development is close to relationship between the two. High-tech exports of a country’s international trade has become a new growth point, its exports along with protection of intellectual property has become a high-tech exports in a very important topic. IPR protection is a social and economic develop technology, knowledge and intellectual property rights in international trade globalization impact to a certain stage of the inevitable product of intellectual property protection and boosting export capability of independent innovation, attract foreign investment and create orderly trading environment and promoting economic and social development in the high-tech product exports plays an important role in safeguarding. Our high-tech exports in some practical problems currently exist:exports dominated by foreign-funded enterprises, state-owned enterprises low proportion of China’s export enterprises’technological innovation capabil ity is relatively low; although the increase of China’s total exports of high-tech products, but the main focus processing trade, indicating China’s export enterprises is not strong R & D capabilities, intellectual property rights and low content of export products; in intellectual property protection, although the implementation of intellectual property protection strategy, but the gap with the developed countries is still great, but faces from developed countries more and more trade disputes.Based on the above foreign IPR protection launched a domestic context influence on China’s high-tech exports, in the case of real analysis, in theory point out the influence mechanism between the two, in the empirical study of intellectual property protection with real data the impact on China’s exports of high-tech products, has certain practical and theoretical significance.This text use qualitative research and quantitative research methods. Recalling the first export-related researches on intellectual property protection and high-tech products, the protection of intellectual property and an overview of the theoretical analysis, to provide a theoretical basis for subsequent empirical; then discuss the relationship between the two, on this basis, specifically addressed intellectual property protection for our high-tech products export scale production interests, export structure and export competitiveness of the impact mechanism, pointing out the positive and negative impact of the performance; Current Situation of China’s IPR protection and high-tech exports and problems; followed by 31 provinces of our country 17 years of data empirical test for panel data regression model results, pointing out the extent of the impact between the two; and finally make relevant policy recommendations from the national and export enterprise level.By theoretical analysis, the paper points out the close relationship between intellectual property protection and high-tech exports, mainly from the intellectual property protection is an important part of high-tech exports, is an important guarantee for exports, penetrate into the export policy, and in high-tech products exports increased strategic position of these four aspects specifically addressed; Analyzing the impact mechanism, the impact of intellectual property protection grasp the scale of high-tech exports, the export interests of the export structure and export competitiveness of these four aspects, analyze specific aspects:the impact of the country’s export scale must be based on practical considerations; although only in the short term to strengthen the protection of the interests of developed countries export favorable, but in the long run; by improving the protection of intellectual property technological content of export products in order to generate the structure of export products to optimize the role; export enterprises by encouraging technological innovation, improve the environment and reduce the export of these three aspects of intellectual property disputes, high-tech products to enhance export competitiveness. Therefore, intellectual property protection for high-tech exports have in raising awareness of property rights of export enterprises, export and create an orderly environment to attract foreign investment and other aspects of a positive impact, but the protection of intellectual property rights lead to unreasonable increase their production costs, limiting the country ability to imitate, intellectual property barriers to becoming a new trade barriers and other negative impacts.Based on the 31 provinces in China from 1997 to 2013 panel data analysis of intellectual property protection degree of influence on the scale of China’s high-tech exports, the choice of domestic patents amount of data to measure the level of intellectual property protection, but also choose the level of economic development in the region, R & D expenditures, the total foreign-invested enterprises and total fixed asset investment index for the six panel regression analysis. Empirical results show that the level of intellectual property protection and high-tech exports correlation great level of intellectual property protection for each 1% increase in the size of high-tech exports to China led to 0.596%, so high-tech exports to China have a facilitating role. Foreign-invested enterprises with a total investment and R & D expenditures on high-tech exports also have a positive influence.We should actively improve the strengthening of intellectual property laws and regulations, strengthen intellectual talent, intellectual property protection up to the national strategic level, actively participate in international cooperation and other aspects of intellectual property protection, and promote better development of high-tech exports; For China’s export enterprises, mainly from the strengthening of intellectual property protection awareness and enhance independent innovation ability to raise the level of intellectual property protection, and promote sound and rapid development of high-tech exports in terms of export volumes, export interests, the export structure and export competitiveness.更多还原
