我国公安文职制度研究

【副题名】以上海公安文职制度现状为例

【摘要】 公安文职制度是现代警察制度的重要组成部分,本文以上海公安文职制度为例,通过问卷调查、个体访谈和资料分析比较等方法,立足总结公安文职制度探索成效,分析发展面临的主要障碍,探讨制度深化发展方向。本文共分为“我国公安文职制度概述”、“国外警察文职制度比较”、“我国公安文职制度存在问题”和“完善我国公安文职制度的思考”四部分。第一章“我国公安文职制度概述”中,从制度概念、建立背景及制度现状等方面对公安文职制度总体情况进行了介绍,并从五个方面对近年来取得的主要成效进行了总结。第二章“国外警察文职制度的比较”中,简要介绍国外部分发达国家警察文职制度实行情况,通过归纳并比较国内与国外警察文职制度的特征,引出下一章我国公安文职制度存在问题。第三章“我国公安文职制度存在问题”中,分别从国家立法、制度定位、政府运作机制保障、公安内部管理等四个层面,对公安文职制度深化发展过程中存在的四方面问题进行了阐述,分别是:“法律保障尚显缺位”、“身份定位尚不明确”、“运行机制有待完善”和“内部管理水平契需提升”。第四章“完善我国公安文职制度的思考”中,与存在问题相对应提出四方面的思考建议。其中,在第一方面“强化法律保障”中,在对法律适用选择的法理与现实进行深入分析的基础上,提出相应的对策建议,即“建立公安文职制度专项立法”,或者“在相关法律中增加公安文职制度的规范性内容”。在第二方面“明确身份定位”中,基于当下制度发展现状,提出公安文职人员身份未来发展有“政府雇员”、“事业编制人员”和“聘任制公务员”三种可能路径,并进行了利弊分析,形成“聘任制公务员身份较为贴切”的倾向性意见。在第三方面“完善运作机制”中,从加强地方政府对公安文职制度的支持、合理调整完善公安文职制度用工模式角度出发,提出三方面建议和思考。在第四方面“提升内部管理水平”中,从“公安内部明确公安文职人员法律地位”、“完善公安文职岗位设置体系”、“加强人力资源管理”及“强化公安文职文化精神引领”等四个方面提出对策,从操作层面进一步推动公安文职制度深入发展。

【Abstract】 Police Civilian System is an important part of modern police system, this paper based on Shanghai Public Security civilian system tries to summary the main achievement, obstacles of development and explores the direction of the deepen development of the system by polls, individual interviews, data analysis and comparison. The paper is composed of four parts, "Overview", "Comparison with Foreign Police Civilian status", "Problems of Development" and "Thinking about How to Improve Police Civilian System"The first chapter "Overview" introduces the basic situation of Shanghai Public Security Civilian System in the aspects of backgrounds of establishment, development process, the status quo, and then summaries some main achievements in five perspectives in recent years.The second chapter "Comparison with foreign police civilian status" make a brief introduction of foreign civilian police force in some developed countries in order to leads to the next chapter "Problems in The Development" of domestic Police Civilian system by inducing and comparing characteristics of domestic and foreign police civilian system.The third chapter "Problems in The Development" respectively describes the four problems in the level of national legislation, system positioning, institutional guarantee of government operations, internal management. The four problems are "significant lack of legal protection and sense of identity", "identity positioning is unclear", and "operation system need to be improved" and "urgent need to improve the internal management level".The fourth chapter "Thinking about How to Improve Police Civilian System" puts forward four suggestions or thinking according to current problems, the first aspect "effectively strengthen the legal protection" brings corresponding countermeasures and suggestions that "the special legislation of Police Civilian System" or "increasing the normative content in relative laws" based on the in-depth analysis of the choice of de jure applicability and current situation. the second aspects "to plan and position system scientifically " brings three possible paths of future development of civilian, there are "government employees", "institution establishment worker", and "appointment of civil servants", the preference of "appointment civil servants" is expressed by analyze the pros and cons. In the third aspect "to improve operation system", three suggestions and thinking are put forward from the perspective of strengthening local government support system for police civilian and improving the system of employment model reasonably. The fourth aspect "to strengthen internal management" brings four countermeasures——"to clarify the internal legal statue in public security system", "to improve the system of civilian job settings", "to enhance the HR management," "to strengthen the leadership of core values"——to promote the further development of the civilian system in the operational level.
