【摘要】 人以食为天,这说明食品是人类赖以生存以及发展的最基本的物质基础,它的安全对于人类的身体健康和生命安全具有重大影响,关乎经济发展和社会稳定。近些年来,虽然中国的食品安全水平与往年相比提高了不少。不过,大量使用农药、兽药,滥用添加剂,以及排放的各种工业、环境污染物和有害元素的污染等,使得中国的食品安全问题频发。这就要求政府对市场进行管制,然而政府管制本身存在诸多缺陷并且导致政府管制低效甚至失效。2013年国务院进行了新一轮的机构改革,其中对食品安全监管体制进行了重大调整。此次食品安全监管体制虽然解决了多头监管的问题,但是改革没有把解决实际监管中的核心难题放在首位,由于我国食品产业的特点以及我国食品安全监管中存在的固有的问题,改革中也存在这一些弊端。本文分析此次食品安全监管体制改革存在的问题以及原因,剖析现有监管体制存在的缺陷,并从宏观方面参考与我国食品监管体制类似的日本在食品安全监管方面的做法,结合我国实际,对我国食品安全监管体制提出可行性建议包括建立独立统一的监督协调机构,实行垂直一体化监管,优化食品安全标准制定体系,完善食品安全监管的监督与约束制度,全面引入国际先进的管理手段等。更多还原

【Abstract】 Foodstuffs are the primary material basis of human being’s survival and development. Foodstuff safety is closely related to human being’health and life safety, will impact our economic development and social stability. In recent several years, food safety in China has been significantly improved, however, there are many food safety problems happened because of abuse of pesticide, veterinary drug and additives, industry, environmental pollutants and hazardous elements. This requires our government to regulate the market. However, defects existing in government regulation will cause regulation inefficiency even causing failure.In 2013, our National council carried a new round of institutional reform, and has made significant adjustments for food safety supervision and management system. This reform did not place the core issue happened in the actual regulation as the first-need-solved problem, although it is somehow solve the multiple-regulations issue in deed. This reform still could be improved due to the inherent characteristics of China’s food stuff industry and problems actually existing in our national food safety regulations. This article analyzes this food safety system reform and disserts some defects existing in our current system. Draft to use Japan’s successful food safety supervision and management system as reference; integrate with reality in China, propose feasibility suggestions, such as the establishment of independent supervision and coordination departments, execute vertical integration regulations, optimize our food safety standard system.improve supervision and restriction system, and introduce international advanced management methods for our food safety supervision and management system.更多还原
