【摘要】 《禁毒法》确立了强制隔离戒毒制度,公安机关是强制隔离戒毒决定的行政主体,作为政府机关的一种涉及到公民人身自由的行政行为,其直接关系到或触及到强制隔离戒毒对象即行政相对人的合法权益的保护。作为一项严格的行政行为,行政相对人程序性权利保护应该受到重视,其对保护强制隔离戒毒决定对象、增强政府行政行为的透明度以及推动我国法治化建设进程都有十分重要意义。2007年以来,我国先后出台《中华人民共和国禁毒法》、《中华人民共和国戒毒条例》、《司法行政机关强制隔离戒毒工作规定》等法律法规以及一些省级规范性文件,从这些法律法规我们可以看出,对强制隔离戒毒决定过程中行政相对人程序性权利规范的少之又少,尤其是对强制隔离戒毒决定过程中行政相对人即强制隔离戒毒决定对象的程序性权利。强制隔离戒毒制度诞生于2007年底,2008年6月份开始实施,历经了将近6年的发展时间,但还是在强制隔离戒毒决定过程中对行政相对人程序性权利的保护方面还存在许多不完善的地方。本文试图从强制隔离戒毒决定过程中程序性权利保护的正当性入手,提出强制隔离戒毒决定过程中行政相对人程序性权利保护的意义,并对我国强制隔离戒毒决定过程中行政相对人(强制隔离戒毒决定对象)程序性权利保护的现状以及其中存在的问题进行全面、深入分析的基础上,进而提出我国强制隔离戒毒决定过程中行政相对人程序权利保护的建设和措施。全文共分为三章内容。第一章主要介绍研究强制隔离戒毒决定过程中行政相对人程序性权利保护的正当性,主要包括强制隔离戒毒决定过程中行政相对人程序性权利的定义、内容以及保护的理论和现实意义,指明了强制隔离戒毒决定过程中行政相对人程序性权利的价值取向就是保证实体权利的实现、提高强制隔离戒毒决定的可接受性、推进强制隔离戒毒发展、推进民主法治建设的进程以及维护公平正义的理念等等。第二章主要从我国强制隔离戒毒决定过程中就存的问题进行了分析和研究,并一一列举。第三章针对第二章分析出的我国强制隔离戒毒决定过程中行政相对人(强制隔离戒毒决定对象)程序性权利存在的问题,提出了完善的设想。其内容主要包括完善法律法规、完善强制隔离戒毒体制、完善强制隔离戒毒行政相对人程序参与权、强制隔离戒毒决定过程中引入律师介入权、完善强制隔离戒毒行政相对人程序性权利的救济机制。更多还原

【Abstract】 "Anti drug law" established a system of compulsory isolation treatment, the public security organ is the compulsory isolation detoxification of administrative decision, as the government a relating to administrative behavior of the personal freedom of a citizen, to protect its directly related to or involving compulsory isolation detoxification object is the administrative relative person’s legitimate rights and interests. As a strict administrative behavior, the relative administrative procedural rights protection should be taken seriously, have very important significance to protect the forced isolation treatment decisions, enhance administrative action of the government transparency and promote the process of building the rule of law in china. Since 2007, China has issued "the people’s Republic of China", "the narcotics control law of the people’s Republic of China drug regulations", "judicial administrative compulsory isolation detoxification work regulations" and other laws and regulations as well as some provincial regulatory documents, we can see from these laws and regulations, the forced isolation treatment decision process administrative procedures right standard is less and less, especially for the compulsory isolation detoxification determines the relative person of the administrative process of compulsory isolation detoxification decide the object of procedural rights. Compulsory isolation detoxification system in 2008, after the development of nearly 6 years, but still in the compulsory isolation detoxification decided to protect the relative administrative procedural rights in the process of many imperfections. This article attempts from the compulsory isolation detoxification decided to start the legitimacy of procedural rights protection in the process, the process of compulsory isolation detoxification determines the relative administrative procedural rights protection significance, basis and rational analysis of the actual operation of China’s compulsory isolation detoxification decided to process the relative administrative procedural rights research problems in the the last, proposes the construction and the measures to protect China’s compulsory isolation detoxification in the decision process relative administrative procedural rights. The full text is divided into three chapters.The first chapter mainly introduces the research of compulsory isolation detoxification in the decision process the legitimacy of the relative administrative procedural rights protection, including the forced isolation treatment decision process the relative administrative procedural rights definition, content and theoretical and practical significance, the value orientation of the compulsory isolation detoxification decided to process the relative administrative procedural rights is the guarantee to realize the coordination, substantive rights of the public power and private rights, to promote democracy and to maintain the idea of fairness and justice.The second chapter mainly from our country compulsory compulsory isolation detoxification process determine the present situation, and existing problems are analyzed and research.The third chapter in view of our country compulsory isolation detoxification decided to process the relative administrative procedural rights problems, puts forward improvement.
