论消费者个人信息权的法律保护

【摘要】 随着信息技术的迅猛发展,互联网络特别是移动互联网的全球化,电子产品性能的快速发展和迅速普及,消费者个人信息的价值逐渐显现,个别不法分子为了攫取消费者个人信息中潜在的巨大价值而不择手段,严重侵犯了消费者的合法权益。但由于法律法规制定滞后的特点,消费者个人信息权的法律保护体系还不够完善,难以有效打击并遏制违法势头,消费者个人信息权的法律保护工作面临着极大挑战。我国对消费者个人信息权的法律保护研究起步较晚,而且大多是在研究个人信息权的保护问题顺便提及,有针对性的研究尚未有突破性的进展。本文将从我国消费者信息权的法律保护现状分析着手,在通过归纳总结我国现有主流观点研究成果和甄别借鉴国外先进经验的基础上,重点就消费者个人信息权法律保护问题中的重要概念界定,性质特点梳理,法律保护运行体系构建等提出自己的见解建议。本文依内容分列四章对相关问题进行了论述:第一章,本章主要就消费者个人信息权的概念、特点、参与者及责任划分、保护的重要意义、法律保护体系要求等基本概念和根本问题进行论述和界定,为后面的具体论述奠定基础、指明方向。第二章,本章主要就我国消费者个人信息权的法律保护现状进行论述评析,通过对我国现阶段消费者个人信息权保护现实状况的仔细研究,找准问题的表面症结,找准问题发生的根源,找准解决的关键之所在,为如何对症下药,构建有效法律运行体系,切实保护消费者个人信息权,找准突破口。第三章,本章主要就国外消费者个人信息权的法律保护进行概述和评析,通过对国外发展的研究,开拓法律体系构建思路,取国外众家法律保护体系之所长,并结合我国实际,做有选择的借鉴,积极推动法律保护体系建设进程。第四章,本章主要在上文研究的基础上,提出符合我国实际的消费者个人信息权法律保护的构想和建议,即建立包括立法、执法、司法、守法、法律监督等五方面内容在内的,五位一体的法律保护运行体系,让消费者个人信息权得到完善的法律保护。

【Abstract】 With the rapid development of information technology, globalization of mobile internet and popularization of electronic products, the worth of consumer’s personal information becomes apparent gradually. Some of the lawbreakers always use unscrupulous divisive tactics to get great value of consumer’s personal information. That is serious violation of the consumer’s legitimate rights and interests. Because of the time lag of law making, the perfect legal protection system of consumer’s right of personal information has not been established, and it can not fight against crime effectively. So we are facing the great challenge on legal protection of consumer’s right of personal information. Not only having started rather late, the research on legal protection of consumer’s right of personal information has not made breakthrough progress in our country. The author tries to start with the analysis of present situation of protecting consumer’s right of personal information. Through the summary of mainstream views in our country and advanced experience of foreign countries, the author gives us his opinions and suggestions on the important concepts and characteristics of legal protection of consumer’s right of personal information, and how to construct the operation system of legal protection.This thesis can be divided into four parts.The first chapter is on the basic concepts, characteristics, participants, division of responsibilities and important significance of consumer’s right of personal information.The second chapter is on the analysis of present situation of legal protection on consumer’s right of personal information in our country, and through finding out the crux and root of the problem in order to effectively protect consumer’s right of personal information.The third chapter summarizes and analyses legal protection of consumer’s right of personal information in foreign countries, in order to construct our legal protection system.The fourth chapter presents us some propositions and suggestions on legal protection of consumer’s right of personal information in our country, including legislation, law enforcement, justice and observance of the law.
