【摘要】 民主是现代政治制度和法律制度的基础。民主理论是每个合法公民都有表达自己观点的自由,这种自由要求合法公民都能够最大程度的得到实现,即言论自由。意大利文艺复兴运动产生了一大批思想家,也产生了很多重要的思想,但丁首创了“人权”一词,对后世的人权制度产生了很大的影响。现代人权制度被各国所接受,写入宪法中。宪法对于言论自由的保障是言论自由得以实现的法律基础。随着科技的进步,电子计算机和互联网技术迅速普及,如何保障网络言论自由对于全球来说有非常重要的研究意义。具体对于新时期的我国来说,如何保障网络言论自由,逐步与国际公约的标准接轨,有着非常重要的现实意义。人们在网络中的言论自由如何得到有效保护,成为目前学者研究的焦点。文章分为五个部分:第一部分为引言部分,主要介绍了言论自由的提出历程,言论自由对个人和对整个社会的作用和影响,指出宪法中确认言论自由是其得以保障的法律基础,而在实践中保护言论自由则是更为重要的环节。研究网络言论自由的宪法保护有着很重要的理论意义和现实意义。第二部分阐述网络言论自由的相关概念。对网络言论自由的含义进行探讨,分析网络言论自由的特征,并在此基础上探讨网络言论自由宪法保护的意义和价值,即体现了公民的言论自由、有助于公民参政权的实现、有助于政府行政行为的透明公开和有助于社会舆论监督的实施。第三部分阐述网络言论自由的宪法保护基本理论。网络言论自由的宪法保护方式主要有四种方式,即从控制公权力的角度对言论自由进行保护、保护的同时也要加以限制、对言论自由保障的同时也要进行合理规制、国家通过颁布单行法来保护和限制言论自由。第四部分介绍国外对网络言论自由的保护制度。在分析德国和美国队网络言论自由的宪法保护的基础上,分析二者之间的共同点和不同,以及对我国的启示。第五部分提出我国的网络言论自由保护的现状和不足之处,在此基础上对公民的意识、法律体系、司法体系以及相关的监管等方面提出几点建议以完善我国宪法对于网络言论自由的保护制度。更多还原

【Abstract】 Democracy is the foundation of modern political system and legal system. Democratic theory is every citizen the freedom to express their views, this freedom for legal citizens to be able to get to a great extent, the freedom of speech. The Italian Renaissance movement has produced a large number of thinkers, also produced a lot of important ideas, Dante pioneered the word "human rights", had a great effect on human rights system. Accepted by the modern human rights system, written in the constitution. Constitution for the protection of freedom of speech is the legal basis for freedom of speech are realized. With the progress of science and technology, computers and the rapid popularization of Internet technology, how to guarantee the freedom of speech for the world has a very important research significance. Specifically for our country in new period, how to guarantee the freedom of expression, gradually with the international convention on standards, has very important practical significance. People in the network how to effectively protect free speech, become the focus of current research scholars.The article is divided into five parts:The first part is the introduction part, mainly introduced the proposed course of freedom of speech, freedom of speech on the individual and the role and influence of the society as a whole, points out the constitution confirm so as to protect the freedom of speech is the legal basis, and protecting freedom of expression in practice is more important link. Research network constitutional protection of free speech has very important theoretical and practical significance.The second part expounds the relative concepts of network freedom of speech. Discusses the concept and the connotation of network freedom of speech, analysis the characteristics of the network freedom of speech, and on this basis discusses network freedom of speech the meaning and value of the constitutional protection, which embodies the citizens freedom of speech, contribute to the realization of citizen participation, help the government administrative behavior of transparency and contribute to the implementation of the social supervision by public opinion.The third part expounded the basic theory of constitutional protection of network freedom of speech. Network of constitutional protection of free speech, there are four main ways which from the Angle of the control of public power to carry on the protection, the protection of the freedom of speech and also want to limit, to the guarantee of freedom of speech and at the same time must carry on the reasonable regulations, the state promulgated by special law to protect and to limit freedom of speech.The fourth part introduces the network system of protection of free speech. On the analysis of the constitutional protection of free speech in Germany and the USA network, on the basis of analysis between the two things in common and different, as well as the enlightenment to our country.The fifth part puts forward our country the status quo of network protection of free speech and deficiency, based on the awareness of citizens, legal system, legal system and related regulatory aspects put forward several Suggestions to improve the system of our country constitution for network protection of free speech.更多还原
