【摘要】 改革开放以来,不同地域、不同行业、不同群体的利益关系各不相同,这既为经济社会发展带来了巨大活力,也引发了一些社会冲突。多元化的矛盾纠纷必然要求建立多元化的矛盾纠纷解决渠道。2008年,阜康市建立了“人民调解与司法调解衔接机制”(以下简称“衔接机制”),从制度上架起了司法审判与人民调解之间的“高架桥”,实现了矛盾纠纷的多元化解决,这一做法在全区尚属首例。经过多年的实践,虽然衔接机制发挥积极的作用,解决了一些矛盾和纠纷,但也存在许多问题。本文以新疆阜康市人民调解与司法调解衔接机制为研究对象,利用文献研究法、调查取证法、比较研究法等,分析了“衔接机制”的产生原因和背景、发展现状和运行情况以及存在的突出问题和原因。经过研究发现,由于受缺乏统一领导机制、经费保障不到位、理念偏差和认识不足等原因影响,“衔接机制”出现了制度不落实、衔接不顺畅,机构人员配置不足,对人民调解认可度不高等三个方面的问题。本文结合阜康市实际,在学习借鉴国内先行先试地区经验的基础上,对完善“衔接机制”给出了三点建议：是加强顶层设计、建立领导机制；二是优化调解组织、提升调解员素质；三是转变思想观念、加大经费保障。更多还原

【Abstract】 Since the reform and opening up, different regions,different industries, different interest groups vary, which not only brought great vitality to the economic and social development, but also inevitably lead to social conflicts. Diversification of conflicts and disputes inevitably requires the establishment of a wide range of conflicts and disputes resolve channels. In 2008, Fukang City established a convergence mechanism of "people’s mediation " and "judicial mediation" (hereinafter referred to as "convergence mechanism"), thus set up a "viaduct" between justice and the people’s mediation by systems, and achieved the diversification of conflicts and disputes resolve, which is the first case of practice in the region. After years of practice, although the convergence mechanism played an active role in settling some of the conflicts and disputes, but there are still many problems.This text taking The convergence mechanism of People’s Mediation and judicial mediation of Fukang City for the study, using the methods of literature researching, investigation,and comparison, analysed the causation and the background that emerge "convergence mechanism", the development status and operational aspect as well as the prominent issues and the resion of it. According to the study, we found out that due to The convergence mechanism of People’s Mediation and judicial mediation of Fukang City lack of unified leadership mechanism, fund guarantee, the impact of the concept of bias, awareness and some other reasons, caused three kids of problems as follows:The system is not implemented, convergence is not smooth, inadequate staffing agencyand as well as the mediation system is not well-recognized. In this paper, combining the actual of Fukang City, on the basis of learning from inland pilot areas of domestic experience, to improve the "convergence mechanism"system, we gives three suggestions:First, strengthen the top-level design, build leadership mechanism; second is to optimize the mediation organization, improve the quality of mediators; the third one is transform ideas, and increase funding guarantee.更多还原
