【摘要】 抢劫罪是指以非法占有为目的,以暴力、胁迫或者其他方法,强取公私财物的行为。该罪在社会生活中案发率极高,且在具体司法适用上存在诸多难题,值得我们深入研究。文章行文近4万字,共分为四章。第一章为抢劫罪的概述,重点论述抢劫罪的概念以及种类。第二章为抢劫罪的构成要件以及构成要件要素分析。通过本章逐一分析抢劫罪的犯罪客体、客观方面,犯罪主体、主观方面。其中,抢劫罪的客体具有复杂性,除了公民的财产权益外还有公民的人身权益;抢劫罪的对象具有多样性,不但包括动产,还包括不动产、财产性利益以及虚拟财产等;抢劫罪的客观方面除了暴力、胁迫等方法行为外,还包括取得财物的目的行为;抢劫罪的主体只需年满14周岁,具有刑事责任能力就行;抢劫罪的主观方面为直接故意,并且具有非法占有目的。文章第三章讨论事后抢劫中的共犯问题,并通过理论案例的结合逐一分析每种情形的处理方式以及处理结论。文章第四章主要将抢劫罪与其他易混淆的财产犯罪相区分。如抢劫罪与敲诈勒索罪的区分,抢劫罪与绑架罪的区分以及抢劫罪与抢夺罪的区分。更多还原
