【摘要】 化石能源不可再生，开发利用过程中对环境污染很大，而且一旦消耗殆尽，将会引发能源危机，社会将会瘫痪。随着科技的发展，具有可替代性和清洁型的可再生能源越来越受到人们的重视，特别是最近，对生物质能的研究热情高涨。生物质能作为一个战略性新型能源产业，是未来最具有发展潜力和前景的新能源之一，对我国的能源发展具有重要意义，尽快使生物质能产业步入产业化进程，最大限度发挥其可替代性的作用是缓解能源危机的重要措施。现阶段，我国生物质能产业发展相对滞后，生物质能产业化进程相对较缓慢。本文主要研究生物质能产业在产业化进程中所遇到的法律障碍和政策障碍。法律障碍主要有法律法规不完善、可操作性不强，我国税收优惠和补贴措施力度不够，可再生能源开发利用监管体系不健全，生物质能企业融资能力弱，未找到生物质能产业与粮食安全的平衡点；政策障碍主要有：生物质能产业发展目标的不合理，生物质能产业化的相关规定未细化，对生物质能原料缺乏统一的管理。并针对上述发展障碍，提出法律和政策建议。通过增强生物质能企业融资能力，保护生物质能相关知识产权，增强相关法律的可操作性，平衡生物质能产业发展和粮食安全，通过完善相关内容，找到生物质能产业的竞争支撑点，保证生物质能产业尽快步入产业化进程。更多还原

【Abstract】 Nonrenewable fossil energy cause many damages to environment in the processof development and utilization. Once is exhausted, the energy crisis will be caused,society will be paralyzed. With the development of technology, new energy which isalternative and clean is getting more and more attention, especially now, theresearchers of biomass energy have a lot of enthusiasm.As a strategic new energy industry, biomass energy which is of importance in ourcountry’s energy development is one of the most potential and prosperous newenergies in the future, so it is an important measure to relieve the energy crisis tomake biomass energy industrialization as soon as possible and make full use of therole of alternative.Recently, biomass energy industry development in our country is relativelybackward and the industrialization of biomass energy is relatively slow. This essaymainly research some legal barriers and political barriers encountered in the processof industrialization. Legal barriers are mainly imperfect laws and regulations,impractical measures, low degree of tax preference and subsidies, unsound regulatorysystem of renewable energy development and utilization, low financing capacity ofbiomass energy enterprise and not keeping balance between biomass industry and thefood security. Political barriers are mainly unreasonable goals of biomass industrydevelopment, undetailed relevant provisions of the industrialization of biomass energy,lack of unified management to biomass materials. Aiming at the above developmentobstacles, some legal and policy suggestions are put forward. By enhancing biomassenterprise financing ability, protecting related intellectual property rights of thebiomass energy, enhancing the maneuverability of relative laws and regulations,keeping balance between development of biomass energy industry and the foodsecurity, through perfecting the relevant content, the supporting point in competitionof biomass industry is found, then make sure that the biomass industry can step intothe industrialization as soon as possible.更多还原
