行政审判体制重构问题研究

【摘要】 党的十八大的召开标志着我国司法体制改革进入深水区，改革的过程虽然面临着很多困难，但也存在着诸多机遇。行政审判体制是司法体制的重要组成部分，然而现行体制已经不适应行政审判职能的需要，因此，探讨如何重构行政审判体制是必要的。研究和探索行政审判体制重构的路径将为司法体制改革全局提供清晰的思路和改革的突破口。行政审判体制是包含行政法律规范、行政审判组织机构结构、行政审判人员等方面在内的综合的复杂的制度体系，全面的行政审判体制重构要从法律规范、组织结构、人员管理等方面多管齐下。我国行政审判体制受传统法制文化影响较深，发展历程较短，制度设计存在诸多不合理因素，因此，改革的节奏不宜过快，需要在探索与实践中稳步前进。本文将从中西方法制文化差异和行政审判体制特点入手，探讨行政审判体制重构的原则和理论基础，在此基础之上再现我国行政审判体制的现状，明确行政审判体制重构的必要性和面临的困境，进而指出行政审判体制重构的目标，通过加强领导、完善行政诉讼法律体系、推动机构改革、完善法官管理制度和强化监督制约等方式实现体制重构，为行政审判组织依法独立行使职权提供切实可行的路径。更多还原

【Abstract】 The ending of18th National Congress of the Communist Party of China marks that china’sjudicial system reform is going into a critical stage. The process of the reform faces manydifficulties but there are still many opportunities. Reconstruction of administrative judicialsystem is an important part of the reform of judicial system，however，the current administrativejudicial system has not adapt to the need of administrative trial activities.So to explore the wayof reconstructing the administrative judicial system will provide a clear thought and abreakthrough of the whole judicial system reform.The system of administrative adjudication is complex because it’s about law, organizationand personnel and all these factors have to be changed together in the reconstruction. China’sadministrative judicial system is deeply influenced by the traditional legal culture.history of thesystem is not long and there are many problems in the system design,as a result,the pace ofthe reform should not be too fast.This paper will start with comparing the differences between Chinese andwestern legal culture and pointing out characteristics of administrative judicial system, then tofind out the principles and theoretical basis of it. On the basis of the principles,we will reproducethe present situation of the system.After that,the necessity of reconstructing the administrativejudicial system and the predicament we have to face will be clear,,In the end of the paper,we willdiscuss the target of the system reconstruction and tell how to reconstruct the system,whichcould provide a feasible way for the reconstruction.更多还原
