【摘要】 欧洲、美洲、非洲都已经建立各自的区域性国际人权法体系，唯独亚洲则属例外。究其内外因素可知，亚洲一个魅丽而又神秘的区域，孕育着46个国家，42.99亿人口，1000多个民族，百余种宗教，先天复杂的文化宗教环境，注定了在该区域一时间难以形成统一的人权价值观。历史上亚洲曾受到欧美等帝国主义长达半个多世纪的殖民统治，被动的权利认知概念，压制了亚洲人民权利意识的觉醒。二战后，民族解放运动兴起，亚洲各国开始争取自身民族的解放，人民自决权由此提出，这一阶段多是民族国家为争取自身权利而奋斗。直至二十世纪七十年代以后，亚洲经济的迅猛发展，对外交流不断扩大，全球化大背景的推动下，亚洲人民的公民意识逐渐觉醒，开始为争取自身权利而奋斗。但是权利的取得不是一朝一夕之事，亚洲人权保护机制的建立更是困难重重。那么亚洲是否有建立人权保护机制的可能呢？随着亚洲次区域人权保护机制的蓬勃发展，亚洲国家、政府间国际组织以及非政府人权组织的推进，可以看出亚洲国家也已经将建立区域人权保护机制提上了日程。然而亚洲国家经济、文化与宗教认同感的缺失，各国间政治互信与安全的缺失，区域综合组织的缺失以及亚洲人民人权保护意识的缺失，都成为了亚洲建立区域人权保障机制的艰难因素。亚洲各国惟有始终坚持人权的普遍性与不可分性，清晰界定主权与人权之间的关系以及确立安全、互信以及合作的观念，方可突破人权领域的桎梏，加快本区域人权保护机制的建设。最后，笔者分析了亚洲人权保护机制建设的路径，以期对亚洲人权保护体系的建设提供新思路。诚然，亚洲建立区域人权保护体制有其先天不足和后天缺陷，但是笔者认为建立一个统一的区域性人权保护体系，不仅惠利于亚洲人民，更为世界人权保护体系的完善做出了贡献。更多还原

【Abstract】 Compared with the mechanism for the global protection of human rights,regional protection mechanism is more flexible and feasible. It is an effective way ofthe international protection of human rights. According to relevant regionalconventions on human rights, Europe, America, and Africa, the three major regions,have set up their own organs for regional protection of human rights and effectiveregional human rights protection system. But, there is still no human rights protectivemechanism in Asia. It is not in harmony with the fast developing economies of Asia.What’s more, there are still many problems of human rights crying out for solutionsin Asia. Under this background, the author devotes a preliminary discussion on theconstruction of Asian human rights protective mechanism based on the previousstudies. On the one hand, this paper can make a positive exploration on how toestablish a mechanism for Asian human rights in theory. On the other hand, it canprovide some advice on how to promote human rights development. So, this researchis of important both in theory and in practice.Under the background of the international human rights, this paper analyses thenecessity of building up Asian human rights protective mechanism based on thereality of Asian human rights protection. Then, the paper analyses the possibilities ofestablishing mechanism to protect human rights in Asia. It points out thatgovernments and non-governmental organizations in Asia have played an importantrole in promoting the protection of Asian human rights, especially the establishing ofsub-regional human rights protective mechanism. The paper further points out thatalthough it is possible to establish a human rights protective mechanism in Asia, therestill many probable practical difficulties in building up regional human rightsmechanism in Asia because of the tremendous differences in historical background,social system, cultural tradition and economic development. At the end, the authorproposes an outlook on the Asian human rights protection mechanism. The authorpoints out two principles that should be followed by Asian countries and makes some suggestions on establishing the mode of human rights mechanism. Although it is noteasy, it is still necessary and possible to establish the protection mechanism of humanrights in Asia. It will help Asian people enjoying human rights to their full extent andpromote the healthy development of international human rights.更多还原
