【摘要】 自上个世纪80年代以来，我国有关部门针对燃气管线工程项目安全管理问题曾经做过多方面的实践和讨论，并且提出过相应的解决方法和改进措施。但是，我国燃气管线工程项目安全管理制度依然存在诸多问题。随着经济体制改革开放不断深入，我国天然气市场的开放化程度越来越高，作为清洁能源的天然气对企业和居民日常生活日益重要。我国燃气管线工程项目安全管理的相关管理制度，以及国家的政策、法律法规有些滞后。2010年6月，第十一届全国人大常务委员会第十五次会议正式通过了《中华人民共和国石油天然气管道保护法》（以下简称《管道保护法》）。《管道保护法》首次从法律角度界定了石油、天然气管道等相关各方的权利及义务，明确了管道活动中的相关法律之间关系，界定了管道管理的主体责任及其保护措施，对有效维护我国石油、天然气管道，保障石油及天然气输送安全，以及保护国家能源安全和维护社会公共安全与维持公共秩序的法律具有重要意义。管道是现代五大运输方式之一，我国的大部分石油（约70%）和几乎全部的天然气（约99%）是通过管道运输的。燃气管道管理直接关系社会公共安全和公共利益。本文在这种新形势的内在驱动下，通过对山东省某公司燃气管线工程项目安全管理的制度分析，对我国的燃气管线工程项目安全管理制度进行创新。本着“走出去，请进来，博采众长、为我所用”的原则，学习、引进与推广应用国外先进的燃气管线工程项目安全管理模式，经过深入剖析我国燃气管线工程项目安全管理存在的制度障碍，提出燃气管线工程安全管理制度创新体系，整体上提升我国天然气安全的管理水平、社会效益和层次，从安全管理制度上保障社会的公共安全和居民的公共利益，以期提升我国燃气运营企业在国际市场上的竞争能力。更多还原

【Abstract】 Since the1980s, security management of gas pipeline project in China had done awide range of practice and discussion, proposed appropriate solutions and improvedmethods and means. But the development of the gas pipeline project securitymanagement still exists problems.With the reform and opening up more in-depth, the degree of openness of ourcountry’s gas market grows very fast, a large number of companies and residents livewithout natural gas. However, the related management system of safety management inChina gas pipeline project, as well as the national policies, laws and regulations lags. In2006the eleven meeting of the fifteenth NPC Standing Committee voted through the"the people’s Republic of China Petroleum and natural gas pipeline protection law"(hereinafter referred to as the “pipeline protection law").At present, the Pipeline iscurrently one of the top five modern modes of transport,70percent of China’s oil and99percent of natural gas is transported by pipeline. Pipeline transportation relates to theeconomic lifeline, but also relates to public safety.“pipeline protection law" for the firsttime from the legal perspective provides the rights and obligations of relevant parties ofoil and natural gas pipeline, sorts out the legal relationship between pipeline activities,formulates the pipeline protective measures, and clears the responsibility to protect. It isan effective law which can protect oil and natural gas pipeline, guarantee their transportsafety, and also maintain the national energy security and public safety.In this situation, security management of gas pipeline project in China should carryon system innovation. We should be the spirit of "going out, please come in, absorbing,as I used" principle, promote the use of advanced gas pipeline project securitymanagement mode, try to solve the existence problem of security management of Chinagas pipeline project, especially the innovation of security management system, enhancethe overall level of China’s natural gas safety management, efficiency and level, therebymake our country has stronger competitiveness in the word.更多还原
