【摘要】 当今,愈演愈烈的环境问题已成为一个国家,甚至成了全球各国不可忽视的难题。面对这样关系着人类生存大计的环境问题和生态问题,为了防止环境问题的恶化,我国采取积极的行政手段解决着环境问题,其中环境行政处罚是人类应对生态破坏,惩处环境违法行为的既普遍又重要的法律手段之一。因此,环境行政处罚的立法研究及其现存问题的探讨不管从实践意义上讲还是从理论意义上讲它都具有深远的意义。本文旨在论证,通过对我国环境行政处罚制度的立法现状的探讨,引出目前我国环境行政处罚中存在的问题进而重构解决对策。我国目前的环境法基本由污染防治法、自然资源利用法、灾害防治法、生态环境建设法及能源法等等组成。而我国环境行政处罚制度的立法体系则由《环境保护法》和《环境行政处罚办法》以及一些环境单行法中的行政处罚规定相结合组成。本文从国家立法、行政立法、地方立法的层面去揭示目前我国环境行政处罚的立法现状。同时,引出目前环境行政处罚中存在的不足之处,并剖析其原因。论文最后一部分是针对上述引出的问题提些建议。首先,协同法律间的冲突,建立统一法律体系。其次,完善我国环境行政罚款处罚计算标准。再次,能够有效的控制自由裁量权。第四、完善环境公益诉讼救济机制。更多还原

【Abstract】 Today, the environmental problem has become a problem of a country even in countries around the world cannot be ignored. Face ways about the environmental and ecological problem of the human existence, in order to prevent the deterioration of environmental problems, our country take active administrative means to solving the environmental problems, the environmental administrative penalty is both common and one of a important legal means of a human response to ecological destruction and punish environmental violations. Because of this, environmental legislation study of administrative punishment and its study of existing problems have profound significance for the theory and practice. Purpose of this article is based on the legislation theory study of environmental administrative punishment system, and to draw out the problems of China’s environmental administrative penalty and put forward the solution.The last part of this thesis is aiming to put forward some advice for the problem of the derivation: first, to coordinate the conflict between legal and legal, to establish a unity legal system. Second, to perfect the standard of our environmental administrative calculation punish, ones again, to exercise control of free discretion.
