我国石油海外投资的法律风险分析

【摘要】 石油作为全球三大能源之一,是人类能源的重要支柱,由于其自身的稀缺性,决定了它天生的重要性。我国的石油资源并不丰富,随着我国经济的迅速发展,石油资源的战略地位愈发重要,国内对石油的需求不断增加,石油对外依存度越来越高,石油供需矛盾不断加深,中国石油企业相继“走出国门,放眼世界”。仔细研究我国企业石油海外投资的整个过程,我们不难发现,法律风险已经渗透在整个过程之中,复杂多变的东道国法律环境以及劳工、环保等法律问题在众多干扰因素中愈发的凸显,导致了我国石油海外投资战略受到了一定程度的影响。如何在未来石油海外投资活动中有效的防范应对所遭受的法律风险,是未来我国石油企业法务人员和法律顾问工作的重中之重。文章共分为五大部分,第一部分列举了我国石油海外投资主要面临的法律风险有哪些；第二部分从三个角度较深的剖析了到底是什么原因使得我国石油海外投资活动遭遇了法律风险；第三部分更深一步的探讨了我们为什么要对石油海外投资面临的法律风险进行防控；第四部分思考化解我国石油海外投资法律风险的防范措施,并对一些措施尝试提出一些建设性的意见,为我国石油企业更好实现的“走出去”战略目标提供一定的理论支撑。更多还原

【Abstract】 Oil as one of the top three global energy, is an important pillar of the human energy, because of the scarcity of its own, it determines the importance of natural. China’s oil resources are not abundant, with China’s rapid economic development, the strategic position of oil resources has become more and more important, the domestic demand for oil is increasing, the degree of dependence on foreign oil is more and more high, the contradiction between supply and demand of oil continues to deepen, "go out of the country Chinese petroleum enterprise, have the whole world in view". The whole process of careful study of petroleum enterprises overseas investment of our country, it is not difficult to find, the legal risks have penetrated the whole process, the legal problems of the complicated and changeable law of the host country environment and labor, environmental protection and other prominent increasingly in many disturbance factors, led to the investment strategy of Chinese petroleum overseas affected. Legal risks effectively in the future petroleum overseas investment activities in the prevention of and response to suffer, is the future of petroleum enterprise legal personnel and legal advisory work priority among priorities.The article is divided into five parts, the first part of the legal risk of overseas investment of China’s listed oil mainly faces what; the second part from the three angles, deep analysis of what is the reason that the activities of overseas investment of petroleum in China encounters legal risk; the third part more step deep discusses why we prevention and control of legal risk facing oil overseas investment; the fourth part thinking to resolve our country petroleum overseas investment legal risk measures, and puts forward some constructive opinions on some measures to try, to provide theory support for Chinese petroleum enterprises to better realize the strategic goal of "going out".更多还原
