我国食品安全检验制度问题研究

【摘要】 食品安全检验是食品安全监管的重要环节,对保障食品安全有着不可替代的作用。我国食品安全检验体系是以多部门分段监管模式为基础构建的。由于近年来食品安全事件频频发生,食品安全形势依然严峻,多个监管部门分段监管的模式已经不适应当前食品安全发展的新形势,有必要对现行的《食品安全法》进行修改。而新修订的《食品安全法(草案)》中,最大的亮点就是对当前我国食品安全监管体制进行了大幅度的改革,即由多部门分段监管模式到一个部门全程统一监管模式的转变。而在改革食品安全监管模式的同时,应当同步对食品安全检验制度进行必要的修改,使其与新修改的监管模式相衔接,最大限度地发挥食品检验对保障食品安全的重要功能。本文以新修订《食品安全法》为契机,深入研究我国食品安全检验制度,运用实证研究方法和比较研究方法,分析我国食品安全检验制度的现实状况,借鉴国外发达国家的先进做法,同时,介绍一些我国部分省市的有益尝试。内容主要包括了四个部分：第一章,绪论。本章以近年来我国发生的典型食品安全事件为切入点,结合《食品安全法》修订动态,确定了文章研究的基本主题。第二章,食品安全检验基本理论。本章先界定了与食品安全检验相关的概念,并对相关概念进行了较详细阐释,以避免相近概念之间发生混淆。第三章,我国食品安全检验制度发展现状与问题研究。本章内容主要对我国食品安全检验制度在各个阶段的发展进行了有益总结,而在论述存在问题过程中,主要以真实案例、调研报告、数据表格等为例证,通过对某些相关案例、原始数据的进一步分析,指出我国食品安全检验制度存在五个方面的问题和不足。第四章,我国食品安全检验制度完善。本章内容是在食品安全检验基本理论的指导下,以第三章章中分析和指出的五个方面问题为基础,结合我国个别省份试点的成功做法和有益经验,提出了针对性较强的完善对策,并进行了相关论证。更多还原

【Abstract】 Food safety Inspection is an important part of the food safety supervision, to ensure food safety plays an irreplaceable role. China’s food safety inspection system based on multi-sector regulatory model based segmentation builds. Due to the frequent occurrence in recent years, food safety, food safety situation is still grim, multiple regulatory segments meet the current regulatory model has been the development of the new situation of food security, it is necessary to present the "Food Safety Law" to be modified. While at the same food safety regulatory reform model should synchronize on food safety inspection system to make the necessary modifications to the newly revised regulatory model of convergence, maximize food inspection of important functions to ensure food security.In this paper, the revised "Food Safety Law" as an opportunity, in-depth study of China’s food safety inspection system, the use of empirical research methods and comparative research method to analyze the actual situation of China’s food safety inspection system, learn from the best practices of developed countries, at the same time, introduce some parts of China are useful attempt. Mainly it includes four parts: The first chapter is introduction. This chapter typical food safety incidents occurred in China in recent years as a starting point, with "Food Safety Law" dynamic, determined the basic theme of the article research. The second chapter, the basic theory of food safety inspection. This chapter first defines the concept associated with food safety inspection, and related concepts for a more detailed explanation, in order to avoid confusion between similar concepts. Chapter III, Status and Problems of food safety inspection system development. This chapter focuses on China’s food safety inspection system at all stages of the development of a useful summary of the existence of problems in the process, mainly in the real case, research reports, data tables, etc. as exemplified in discourse, by some relevant cases, the original data further analysis, pointing out problems and deficiencies in five areas of food safety inspection system. The fourth chapter, China’s food safety inspection system improved. This chapter is under the guidance of the basic theory of food safety testing to the third chapter five chapter analyzes problems and noted, combined with our successful practices in individual provinces pilot and useful experience, made highly targeted improvement countermeasures, and related demonstration.更多还原
