【摘要】 历史建筑保护正在走向法制化管理的现代化建筑保护进程。为此国家陆续修编、发布了各项法律规章不断地进行补充指导，但仍然有大批优秀的历史建筑特别是优秀近现代建筑被拆被毁。作为人类未来能留给子孙后代的宝贵的文化遗产，为什么“无价”会变成“无价值”？传家宝怎么就变成了“赔钱货”？如何通过法律政策激励人们保护历史建筑就显得尤为重要。本文将立足已有的文献研究、已出台的各项法规及现场调研，整理部分西方在激励机制方面的经验，梳理国内现行的城市近现代建筑保护规划管理在激励政策方面的努力，分析施行过程中的相关问题，总结目前相关不足之处。对比中西方差异，分析原因，结合我国国情提出切实可行的相关激励策略。本文将分为以下章节：第一章对文章中的研究对象“历史建筑”进行明确的界定，确定本次研究的思路和方法，并综述目前国内相关研究情况；第二章对各国历史建筑保护的发展历程以及相关法规的发展演变进行梳理。明确“激励机制”的概念，引入管理学中激励机制的相关含义和类型，启发本次关于历史建筑保护激励机制的研究思路；第三章、第四章中归纳、总结国内外在历史建筑保护方面所做出的激励举措。第五章通过对比中西方在保护资金来源、税收优惠、银行贷款、建立相关保护机构、提高公民的保护意识、免除相关审批费用等方面的激励举措，分析我国目前影响激励机制完善的原因所在，确立“自上而下”和“自下而上”的对策体系。第六章、第七章分别从“自上而下”和“自下而上”的角度，收集各种激励机制的案例，并结合实地调研访谈内容进行分析，提出建议。更多还原

【Abstract】 Modern historical buildings protection process officially legalized management.Additional guidance laws and regulations continuously are taken in the protection of modernarchitecture, but there are still a large number of outstanding new modern architecturebuildings destroyed. As the human cultural heritage which can be left to the youth in thefuture, the modern historical buildings are turning from valuable to useless. Why could it bemade from "priceless" fortune into "no value" architecture? So it is so necessary andimportant to encourage the public to protect the modern historical building through theincentive policy.The regulations and the field investigation in this paper will be based on the existingliterature research in addition to the incentive mechanism of European experience. Thecurrent incentive policy of modern architecture protection in China will also be summerised.Through the compared between Chinese experience and Western experience and analyses inthe confusing puzzles exposed in the practical management, the positive areas andencouragement can be showed. At the end of this article the relative suggestion will beraisedThis paper will be divided into the following sections:In the first chapter,"the historical buildings" in this article is clearly defined. The ideasand methods in this study are made sure. The current domestic related researches aresummerised.In the second chapter, the development process to protect historic buildings for westerncountries and related regulations are summed up. The definition of "incentive mechanism" isexplained and cleared. This definition and summery can inspire the method about historicalbuilding incentive mechanism research.In the third and fourth chapters, the domestic and western protection in historicalarchitectures are summed up.In the fifth chapter, through the domestic and western protection of historicalarchitectures, for example, sources of funds, preferential tax, bank loans and so on, the mainproblems affecting incentive mechanism can be proved and seen. Besides the system toresolved the problems can be established in two ways,"top-down" and "bottom-up".In the sixth and seventh chapters, from the "top-down" and "bottom-up" point of view,the practical examples and cases are selected.
