【摘要】 城市园林绿化直接作用于城市居民的日常生产、生活,充分展现了一个城市的建设发展水平,是人文景观、城市形象的重要表现,同时它还体现了一个城市的文明程度和城市品位,也是城市环境长期可持续发展的重要基础。而园林法规是城市园林绿化发展的重要法律依据,政治、经济的转变直接影响立法者的立法意图,而政治、经济的发展同样在促进城市园林绿化发展的情况下推进法规体系的完善。论文通过对我国园林法规的立法进程,以法律、行政法规(部门规章)、地方性法规(规章)为序,探讨了园林法规与城市园林绿化发展间的关系,强调了园林法规对城市园林绿化发展的重要引导作用。论文又以宁波城市园林绿化的发展为例,通过实证的方式来印证政治、经济发展对城市园林绿化发展的推动作用,以及由此而出现的地方性法规不适用的现象,从而印证城市园林绿化发展对园林法规的发展也具有积极的推进作用。最后,本文结合园林法规的立法进程与城市园林绿化的发展,结合实践,探讨了我国今后城市园林绿化的发展趋势,对我国园林法规体系的建立提出建议和设想,希望城市园林绿化能有更好的发展提升。更多还原

【Abstract】 The effect of the city garden planting will directly benefit citizen’s everyday life. It reflects the development of civilization and modernization of a city, as well as its cultural sight and urban grade. It also provides a solid foundation for the long-term sustainable development.The landscape law system is the vital legal support for the development of urban virescence. The change in politics and economy has effect on the purpose of lawmakers; thus, political and economic factors play a positive role in accelerating the development of landscape law system.By looking in to the process of China’s landscape lawmaking, based on the law, regulation, department law, this essay main discuss the relationship between landscape law system and the development of virescence, especially the positive guiding effect of such a law system towards the development.The example in this essay is taken from the development of Ningbo’s urban virescence project. By revealing the political and economic effect on the process of urban greening, which causes the faults in the local policy in a clear and straightforward way, it provides the evidence that the process of city greening has a positive effect on the landscape law system.Finally, based on the landscape law making process, the development of the the process of city garden virescence and the practices, this essay discusses the development trend in China’s city garden greening. The accordingly suggestion and hypothesis will also be given as well, in order to build a brighter future for the the process of city garden virescence.更多还原
