网络团购中的消费者权益保护法律问题研究

【摘要】 目前在我国,网络团购以其开放性、低廉性、和便捷性等优点,已愈加深入人们生活之中,但在其发展过程中,与普通网购相比,存在较多侵犯消费者权益的现象。究其原因在于:团购网站良莠不齐、缺乏专门的立法规范和行政监管等。本文以网络团购中的消费者基本权益保护为研究对象,通过分析目前网络团购中普遍存在的侵犯消费者权益的事实,结合中国的立法现状,就网络团购中消费者权益保护机制的完善提出了建议。本文首先探讨了网络团购的定义和分类;其次在厘清基本概念的基础上,利用分类和案例分析的方法,系统分析了网络团购中的消费者权益易被侵犯的几种情形;第三,分析目前国内的网络团购消费者权益保护的现行机制和状况;最后结合我国立法现状,剖析了现行团购消费者权益保护机制的不足,从而提出了统一在线支付平台、严格市场准入标准、加强经营者披露义务、灵活运用售后评价制度等若干建议。
【Abstract】 At present in our country, the online group-buying with the advantages of low price, openness, and convenience, has been more deeply in people’s lives, but in the course of its development, compared with the common online shopping, there are many phenomenon of violations of consumer rights. The reason is:the group purchase website uneven, some good and some bad, lack of specialized legislation and administrative supervision.In this paper, consumers in the network group purchase of the basic rights protection as the research object, through the analysis of the ubiquitous network group purchase of violations of consumer rights fact, combined with the current legislation China, puts forward some suggestions on perfecting the consumer rights and interests protection mechanism in the network group purchase. This paper first discusses the definition and classification of network group purchase; the second is based on clarifying the basic concept, the classification and case analysis method, system analysis several cases of network group purchase of consumer rights and interests are easy to be infringed; third, analysis of the current network group purchase of consumer rights and interests protection of domestic existing mechanisms and conditions; with the final status legislation in our country, analyzes the deficiencies of current group purchase consumer rights and interests protection mechanism, and put forward a unified online payment platform, strict market access standards, strengthen management of the duty of disclosure, flexibility in the use of some suggestions and evaluation system after sales.
