【摘要】 社会的善良风气是我国文明的历史传承，人们在社会生活、商业活动等活动领域内，可能会作出诸如见义勇为、诚信交易等值得肯定的行为。但是，在一些特殊的情况下，人们的某些善意行为却可能导致行为人卷入有因或者无因的法律麻烦之中，一个本来显而易见的善意作为或者不作为可能成为诉讼中有责的证据。当行为人诉诸于法律时，法律如果仍然紧扣民事证据规则，而忽略善良风气的鼓励与传扬，那么人们在今后的生活中将不敢为、不愿为善良行为。因此，司法审判作为道德的敏感调节器，虽然不能因道德作出违背法律的裁判，但却应当为了某些道德需要明示善行善意的鼓励规则，从来降低法律对道德行为的阻碍。参照英美法的相关规则，构建起一套证据排除体系，根据公共利益的需要，由法官对使用该证据的司法利益和造成损害的公共利益进行权衡，若损害的公共利益大于司法利益，则最终排除该证据的使用，以牺牲证据规则为代价，保护善良的社会风气和个人的良知。更多还原

【Abstract】 The atmosphere is kind of social civilization and historical heritage of our country,people in social life, business activities and other areas of activity, subject to suchcourageous, honest transactions worthy behavior. However, in some special cases, people’s behavior is likely to lead to some well-intentioned actors involved have no reason orbecause of legal trouble, an apparent goodwill originally an act or omission may beresponsible for the proceedings, there is evidence. When the perpetrator recourse to thelaw, the law is still closely linked to the civil rules of evidence if, while ignoring the goodatmosphere of encouragement and preach, then people will not in the future life isunwilling to act as a kind-hearted. Therefore, the administration of justice as moralsensitivity adjuster, although it can not be made against the law because of moral referee,but it should be required for certain moral rules expressly encourage good deeds ofgoodwill, never reduce legal obstacles to ethical behavior. Reference to the relevant rulesof the common law, built up a set of exclusionary system, according to the public interest,by the judge of the evidence on the use of damaging the interests of justice and the publicinterest to weigh the public interest if the damage is greater than the interests of justice,the final exclude the use of evidence, the rules of evidence at the expense of the cost ofprotecting the good social atmosphere and personal conscience.更多还原
