夫妻忠诚协议效力的实务分析

【摘要】 鉴于目前婚姻关系的不稳定以及现代自由主义思想的极端化和思想多元化等各种因素的影响，夫妻之间的不信任感加剧，在这一大背景下，出现了“夫妻忠诚协议”这一概念，顾名思义，就是以忠诚为实现条件，以一定行为作为标的的协议，尽管这一协议出现的时间较早，但是围绕这一协议的争论却并未停止，从目前的理论倾向来看，支持其有效者占据多数，然而，应该注意的是，该协议有其特殊性，不宜简单将其归结为有效的协议，本文将从其所涉及的道德领域中可能带来的问题来探讨这一协议的深层隐忧，重点从夫妻忠诚协议出现的背景，概念特征，效力判断，结合司法中对于该类协议所作出的判决来探讨这一协议的效力问题，尽可能做到系统、全面的论述。更多还原

【Abstract】 Under the influence of permissivism、diverse idea and unstable marriage,the coupledoes not trust each other as they used to be. In this case, loyalty agreement emerged at ahistoric moment. This contract means that if either person in marriage has theextramarital sex,he/she need to delivevy a large amount of money or some acts.Although this agreement emerged in early days,the debate on its legally binding hasnever stoped. Untill now,the idea to plunk for it valid take over central position. Well,aswe know,this kind of contract is different from the business agreement and we need toconsider its particularity. We can not affirm its legally binding simply. In my paper,Ichose an aspect——the loyalty agreement may cause some insurmountable problems inthe fields of morals——and combine its background、concept and the idea in judicatorypractice on this agreement to discuss the legal effect of this contract as detailed as I can.更多还原
