【摘要】 未成年人是国家的未来,是民族兴旺的根本,但当今中国未成年人犯罪率居高不下,未成年人犯罪已成为迫切需要解决的问题。如何更好的教育挽救未成年犯罪人,也成为各国学者研究的课题。社区矫正制度国外研究的较早,形成了较完备的理论体系。我国于2003年在上海等六省市开始进行社区矫正的试点,此项工作的开展一直贯彻“教育为主、惩罚为辅”的原则,至今已在全国范围内推广这一制度,并收到了良好的效果。但与发达国家相比还有相当差距,很多不足还需要完善。本文从未成年人的界定这一基础问题入手,论述了未成年人犯罪概念、未成年人犯罪社区矫正的概念、未成年人犯罪特点和原因、国外此项制度的状况、我国未成年人犯罪社区矫正的现状、存在的不足及完善建议,希望通过此文引发共同探讨,为我国最终建立系统完整的未成年人犯罪社区矫正制度提供行之有效的办法。更多还原

【Abstract】 Juveniles are the future of our country and the foundation of our nation. At present, because of the high juvenile’s crime rate, the juvenile’s crime becomes an urgent problem to solve. How to educate and remedy the juvenile criminals in a better way has become the topic to research in many countries.Community correction has been researched for a long time in foreign countries, and become a complete theoretical system. Community correction has been made experiments in six areas in China, such as Shanghai etc, in2003. Our country always follows on the principle of "First place for education, second place for penalty" to popularize this system, and has got good effect. Comparing with the developed countries, we still have many shortcomings to improve.This thesis has a beginning of the concept of juvenile, and discussed the concept of juvenile’s crime, the concept of community correction of juvenile’s crime, causes and characteristics of juvenile’s crime, the situation in foreign countries and China, shortcomings and improvement suggestions. The author hopes that this thesis can trigger more discussions, and attract valuable comments in order to construct an integrative community correction system of the juvenile’s crime in China.更多还原
