【摘要】 孟加拉湾位于印度洋北部，西临印度半岛，东临中南半岛，其在南亚乃至世界都具有重要的地缘战略意义。与之相对应的，孟加拉国与缅甸在该海域的划界案作为国际海洋法法庭有关海洋划界的第一起判决，该案的成功审理对世界海域划界争端的有效解决带来的意义不言而喻。孟加拉湾海域划界案涉及区域为争端国的领海、专属经济区以及大陆架。其中，孟缅两国在领海划界的争议在于既定协议的效力、禁止反言原则的适用以及圣马丁岛的划界效力；专属经济区和200海里内大陆架争议为划界方法的选择和特殊情况的考量；200海里外大陆架的争议在于法庭的管辖权问题以及自然延伸原则的适用。本文也相应的从这些争议入手，运用相关国际法法理对当事国在该区域的诉求以及法庭裁决作了一个详细深入的评析。此外，本文对中日东海划界争端进行了分析阐述，并将国际海洋法法庭对孟加拉湾海域划界案的裁决中所应用的与东海问题相关法理进行了整合比较，以求为中国在东海海域争取到最大利益提供法理支持。更多还原

【Abstract】 Bay of Bengal is located in the northern part of the Indian ocean, with the Indiansubcontinent on the west, and the Indo-China Peninsula on the east. Therefore, it hasimportant geopolitical strategic significance in South Asia and even in the world. Thecase of demarcation between Bangladesh and Burma, which are related to Bay ofBengal, was the first verdict about maritime demarcation in ITLOS. Successful trial ofthis case brought significant meaning to the dispute solving in the maritimedemarcation around the world. Case of maritime demarcation in Bay of Bengalinvolved three problems among dispute countries, they are territorial waters,exclusive economic zone and continental shelf. Among them, Bangladesh and Burmabilateral disputes in maritime boundary delimitation is applicable effect, establishedprotocol of estoppel prohibited and Saint Martin Island delimitation effect; theexclusive economic zone and the continental shelf dispute within200nautical milesas the demarcation method and special considerations apply;200nautical miles offthe continental shelf dispute is the jurisdiction of the court and the principle of naturalprolongation. From the angle of the three disputes, the paper discussed and analyzedthe appeal of the countries involved and the adjudication by using relevantinternational laws and legal theory. In addition, the paper has analyzed thedemarcation dispute between China and Japan by integrating and comparing therelevant laws and principles in this case in order to provide our country with legalsupport in striving for best interest in this respect.更多还原
