【摘要】 随着人们生活水平的不断提高，人们对生命质量的期望值也不断的增长，但是我国目前有限的医疗服务水平和服务质量，跟人们所期望的要求存在着一定的差距，这就造成了医疗纠纷的大量存在，以致发生“医闹”现象。医疗纠纷成为社会的热点和难点问题。宁波市在探索解决医疗纠纷的道路上比别的城市启动的早，业界对宁波处理医疗纠纷的做法称为“宁波解法”。“宁波解法”经过近几年的不断摸索，取得了一些成绩，但是还是有很多需要完善的地方，本文通过调查分析，希望能够对医疗纠纷的完善提出一些合理性建议。本文第一部分宁波地区医疗纠纷人民调解委员会的实践。详细的介绍宁波地区医疗纠纷人民调解委员会的具体做法，从立案受理、宣传告知、调查调解、协议签订、结案归档五方面进行论述。宁波地区医疗纠纷人民调解机制的优势主要表现在使患者合法权益得到维护、正常医疗秩序得到保障、防止国有资产流失、医疗服务质量监管得到加强等四方面。本文第二部分，宁波地区医疗纠纷人民调解委员会在实践中存在的一些问题。主要表现在赔偿标准不明确、调解工作监督考核机制不够完善、保障机制不够、专业人才匮乏。本文第三部分，针对宁波地区医疗纠纷人民调解委员会在实践中存在的一些问题，提出了完善的意见。主要从加强专业调解人才队伍建设、将医疗纠纷人民调解规定为诉讼的前置程序、加强保障机制建设、建立调解工作的考核机制、建立专门的医疗纠纷人民调解法这几方面进行论述。更多还原

【Abstract】 With the improvement of living standard, people are expecting more for the qualityof life. However, as the medical service and care cannot match the expectation from therequest of most people, there are a great deal of conflicts between hospital and patients.And the complaints about hospitals are growing larger, which become a hot issue and adifficult problem in the society. In Ningbo, the exploration for the solutions started quiteearly, which were called as “Ningbo Solution”. Its experience, both positive and negative,can help to provide some insights for the solution of conflicts between hospital andpatients.The first part of the essay is about the practice of Ningbo People’s MediationCommittee. There will be a detailed introduction on what the committee is doing to solvethe conflicts with five steps-the prosecution, the notice, the investigation, thenegotiation and the filing. The advantages of its mechanism lie in four aspects: theprotection of legal rights of patients, the guarantee on medical regulations, the preventionfrom the loss of state-owned enterprise and the supervision of medical service.In the second part, the author will mention about some problems in the practice ofthe Committee, especially on the ambiguity of compensation, the examination mechanismof mediation work, the lack of professionals and etc.In the third part, the author will provide some advices on how to improve, mainlyfrom five aspects–the professions of working team, the regulations to set mediation asthe preconditions of litigation, the enhance of protection system, the establishment ofchecking system and the set-up of regulations on mediation of medical problems.更多还原
