【摘要】 随着世界动物福利保护思想的传播和我国经济发展之上人性文明诉求的扩展,在面对当今我国出现的诸多动物虐待事件时,我们除了对虐待动物的行为强烈谴责之外,另一方面则更应痛在反省我国动物保护现状存在的两大矛盾,即一是动物保护与动物虐待行为并存,且各自有自发走向其极端的矛盾趋势。二是民众业已形成和发展的动保思想和期待与我国当前动保保障制度严重缺失之间的矛盾。为何在以动物福利为核心的动物保护运动风起云涌的今天,虐待动物事件在我国却层出不断?从“高跟鞋虐猫”、“汉中打狗”、“归真堂活熊取胆”再到最近的“阆中民警当街杖毙流浪者的狗”等事件,均反映出因我国动物保护立法缺失所带来的惨痛后果。动物虐待行为不仅扰乱社会秩序、损害民众健康,而且阻碍了国际贸易和科学技术的发展,在国际形象等许多方面也都带来了不利的影响。动物保护立法最早出现于英国,而如今,已经有包括美国、日本、欧盟、新西兰在内的上百个国家和地区制定了自己的动物保护法或者动物福利法。而我国,由于经济社会、文化传统等各方面的限制,动物保护立法长期存在缺失。本文首先阐明动物保护法的内容和意义,梳理和回顾西方主要国家在动物保护立法方面的理论研究和实践脉络,对比西方动物保护立法,找出对我国的可借鉴之处,立足对我国动物保护立法的现状,对如何完善我国动物保护立法提出思考和建议,以期待为我国动物保护立法研究做一些有益的探索。更多还原
