容留卖淫罪司法适用问题研究

【摘要】 本文结合容留卖淫罪在司法实践中的具体问题,比较中外立法,找出我国相关容留卖淫罪的立法中存在的一系列问题,进而根据现行法律规定给出一系列完善建议,以期其更加合法合理且具可操作性地解决实践中容留卖淫罪的问题。首先,对卖淫罪进行整体性描述。从罪的立法演变至容留卖淫罪的概念、以及此罪的犯罪构成要件方面,进行总体概述。其次,对容留卖淫罪司法适用中存在的问题进行分析。从实际案例的实案争议考察、到通过对刑事政策与刑事基本原则、立法规定三方面进行理论分析,全方面展示该罪存在的问题。针对容留卖淫罪此罪名本身,具体分析我国容留卖淫罪司法适用中存在的问题与诸多争议。最后,是基于罪责刑相适应的刑法基本原则和宽严相济刑事政策以及法律需适应当今社会现实的基本思路,从解决容留卖淫罪疑难问题的角度,分别从刑法立法、司法解释层面对容留卖淫罪的完善提出一些建议。更多还原
