【摘要】 胜诉策略是一个非常复杂的问题，尽管学界一直将其当做实践性的问题来处理，并认为只有经验丰富的大律师才能够写出相关的专著来指导实践，但这个问题背后还是有很强的理论内核。胜诉策略与律师代表当事人提出的事实主张息息相关。事实主张是诉讼请求的基础，由于实践之中的具体案情纷繁复杂，其中可能能够抽象出许多种法律关系，而这些法律关系有时会出现互相竞合的情况，需要面临选择。而这种选择的过程，正是律师运用自己的专业知识和缜密的逻辑对事实主张重新建构的过程。对事实主张的建构并不同于法学界近年来研究的法律事实建构论，后者针对裁判事实，而裁判事实的形成是多种因素作用的结果，并且需要遵循严格的程序限制。这里并无意对裁判事实的形成做过多的讨论，而是将建构的内容和范围严格限缩在事实主张的维度内，并通过对胜诉策略与被建构的事实主张之间的逻辑关系的研究，具体拓展到对诉讼方案设计的研究上。诉讼方案，是律师能否从宏观上把握案件，充分利用可控因素的体现。律师应当以完成胜诉结果为目标将自己诉讼上的每一步串联起来，无论是诉讼请求的确定还是证据材料的选择，都应当建立在此基础之上。文章主要在实证研究基础上综合运用语义分析方法和历史分析方法展开论述。而创新之处在于将律师的诉讼策略在庭审辩论策略的局部研究基础之上拓宽思路，关注律师对于诉讼全局的策略性考量，期望对于事实问题的研究和对于胜诉策略的分析都能更深一步，而不是简单的停留在经验事实的总结层面上，同时能够抽象出一般理论，为律师今后的执业活动提供借鉴意义。更多还原

【Abstract】 Successful strategy is a very complicated problem. Though the scholarsregarded it as a practical problem and thought that only experienced lawyers couldwrite works in this field, this problem has theoretical value. Successful strategy isrelated to objective claim. The later is the foundation of litigation. From cases wecan get many legal relations, and these legal relations sometimes are concurrency.We must choose one as our objective claim. The process of choosing is theconstructing to the objective claim.Constructing to the objective claim is different from fact-constructing, the laterput focus on adjudicative fact. Adjudicative fact is affected by many factors andmust be limited in due process. This paper donnot discuss the process ofadjudicative fact. It is the research of the relationship between successful strategyand constructing to objective claim and the research of litigation plan. Lawyers mustdesign specific plan according to specific cases and control the wholemacroscopically to finish the success of litigation. The claims and evidencematerials should be determined by this.This paper was discussed with empirical study, semantic analysis and historicalanalysis. The innovation is that widen the train of thought and focus on the strategicthinking. Hope through this research can put the constructing of objective claim andsuccessful strategy further and provide reference to our lawyers.更多还原
