【摘要】 依法治国是我们国家在中国共产党的领导下治理国家的一个基本的总方略。这种治国理政方略是我国发展社会主义市场经济的客观需要，是我国社会文明进步的重要标志。司法公正是依法治国方略方面的一个重要的体现，自《中华人民共和国监狱法》的颁布和实施后，监狱那些在押的服刑人员的生命健康等权益越来越受到重视和保护，监狱管理的科学化、文明化和现代化程度不断提高。监狱内部专门负责服刑人员医疗健康和卫生防疫的特殊部门——监狱医院，在司法狱政体系有着重要的地位。由于主观和客观条件的原因，我国监狱医院现有的医疗水平和实际保障能力与服刑人员健康的高标准需求之间仍然存在不小的距离，且有越来越加大的趋势，造成监狱医疗纠纷和医疗事故不断增多，处理不当就会影响我国政府的司法执法形象。本文旨在通过分析吉林省监狱医疗卫生服务供求关系的特征及影响因素，进而指出其中存在的矛盾并分析其成因，最后提出解决监狱医疗服务供求矛盾的对策，以求尽可能地规避监狱医疗工作中存在的风险，平衡监狱医疗服务中的供求矛盾，从而更有力地保障监狱内的安全稳定，推动我省监狱医院医疗事业的发展。本文主要分为四个部分：第一部分，主要是“以监狱医疗卫生服务主体的特异性为切入点，对监狱医院本身行政管理体制的特殊性，监狱医院医疗对象的特殊性，监狱医院医务人员的特殊性等三个方面进行分析，”①说明监狱医院有别于社会医院的主体差异性。第二部分，主要是阐述吉林省监狱医疗卫生服务供求中的六种矛盾，分别为：监狱医院医疗水平与服刑人员日益增长的健康需求的矛盾，监狱医院实际保障力与服刑人员日益增长的健康需求的矛盾，服刑人员的误导性主述与临床医生诊断依赖性之间的矛盾，应给予的人道主义基本医疗与监狱必须包治百病的现状的矛盾，医疗行为的风险性和不确定性与病犯家属的期望值过高的矛盾，监狱医院的医疗保障职能与部分病犯及其家属的片面强调“维权”的矛盾。运用矛盾分析的方法，指出吉林省监狱医疗卫生服务存在的主要问题。第三部分，运用行政管理学的方法，从监狱医院的制度体制、人员的准入关口、医患关系、服刑人员及其家属等六方面来分析吉林省监狱医疗卫生服务供求矛盾产生的原因。第四部分，运用行政管理学的方法，从体制机制、职能定位、人才培养、法律界定、长效沟通机制等方面提出吉林省监狱医疗卫生服务供求矛盾的解决对策。更多还原

【Abstract】 Our country has embraced the rule of law as the basic means of regulating societyunder the leadership of the communist party of china. The governing strategy is not onlythe objective requirement of developing socialist market economy in our country, butalso an important symbol of social civilization in our country. Judicial justice is animportant embodiment of the rule of law. Since the promulgation and implementationof the 《PRISON LAW OF THE PEOPLE’S REPUBLIC OF CHINA》, life andhealth rights and interests of those in prisons has been paid more and more attention andprotection. At the same time, the scientific, civilized and modernized degree of theprison management has been improved constantly. Specializing inside the prisoninmates special department of health and anti-epidemic, a prison hospital, in the judicialif the system has an important position. Because of subjective and objective conditions,the prison hospital existing medical level and actual support capability and the prisonersthere is still a big gap between demand the same high standards of health, and the trendof more and more, increasing medical disputes and medical accident, improper handlingcan affect our country judicial enforcement image of the government.Through the analysis of the characteristics and influence factors of prison healthservice supply and demand in Jilin province, the purpose of this paper is to point out itsnature, analyze its causes, and get proposal solutions of the prison medical servicesupply and demand contradiction. Moreover, this paper is going to hedge the existingrisks in the work of prison medical, balance the supply and demand contradiction in itsservices, ensure security and stability of the prison more effectively, and promote thedevelopment of our prison hospital medical career as far as possible.This paper is divided into four parts: The first part, mainly based on the specificity of the prison health service, mainbody as the breakthrough point, to the prison hospital itself to the particularity of theadministrative system, the particularity of prison hospital medical object, theparticularity of prison hospital medical personnel and so on three aspects carries on theanalysis, explain differences between prison hospital is different from the social mainbody of the hospital.The second part, Jilin province in mainly expounds six contradictions in prisonhealth service supply and demand, respectively is: prison hospital medical level and thecontradiction between the increasing health demand, prison hospital actual ability andpersonnel to the contradiction between the increasing health demand, inmatesmisleading Lord Assyria and the contradiction between the clinical doctors diagnosisdependency, should be given the present situation of the basic medical and humanitarianprison must cure-all, the contradiction of the medical behavior and the risk ofuncertainty and sick family expectations too high, the contradiction of the prisonhospital health care function and part of the illness and their families made thecontradiction between the one-sided emphasis on "human rights". Using the method ofcontradiction analysis, points out the main problems of Jilin province prison medicaland health services.The third part, the article USES the method of administrative management, thesystem of the hospital from prison system, personnel admittance threshold, thedoctor-patient relationship, prisoners and their families and so on six aspects to analyzethe causes of Jilin province prison health service supply and demand contradiction.The fourth part, using the method of administrative management, puts forward thesolution to the supply and demand contradiction of the prison health service in Jilinprovince, from the system and mechanism, function orientation, talent cultivation,legally, the communication mechanism and other aspects.更多还原
