【摘要】 自从国家产生，监狱就作为暴力机关存在。监狱，尤其是女子监狱作为刑罚执行的机关，其执行主体具有法定性，对象具有特殊性以及执行内容具有复合性的特征。女子监狱刑罚执行具有惩治罪犯，改造罪犯的功能。但是，惩治和改造罪犯只是监狱刑罚执行的手段，其最终目的是实现教育罪犯和其他人，维护社会的稳定。随着监狱刑罚执行使命的拓展和转变，以及罪犯特点、结构的变化，使得监狱管理教育方法、模式、理念、硬件等等方面在因时转变的过程中出现了一些问题，暴露出了一些陈旧的、不合时宜的认识和做法。目前，我国女子监狱刑罚执行存在比较突出的现象：劳动强度过大；轻人防，物防、技防措施滞后；重改造，轻病犯权益；长、短期刑交叉感染，矫治难等。应该说，女子监狱刑罚执行有一个逐渐成熟完善的过程。客观上讲，目前女子监狱刑罚执行所面临的问题是在发展和前进中遇到的问题。社会的发展、时代的进步、中国特色社会主义法制建设的不断推进都赋予了司法体系中监狱刑罚执行新的内涵，社会对刑罚执行作用发挥有了新的期望和定位。在这个大背景下，当前女子女子监狱刑罚执行的现状与任务变化、实施需求相脱节。从组织领导和工作指导上具体分析，主要存在着重视程度不够、管控不科学、执行不严格、动态研究不深等原因。因此，对于女子监狱刑罚执行过程中存在的问题，首先需要完善物防、技防等基础设施。其次，在监狱刑罚执行中，在改造罪犯时将劳动与矫治相结合，创新管理模式，完善分层管理机制，构建团体心理教育、辅导机制。同时，加强女子监狱狱警队伍的建设，提高狱警素质，保障女子监狱狱警的权益，完善女子监狱狱警的责任机制。最后，建立健全相关的配套措施，完善教育体系，监督机制以及对罪犯的考核机制。更多还原

【Abstract】 Since countries, prison is as the organs. Prison, especially the women’s prison as apunishment execution organs, with statutory executive main body, object has particularity,and perform content has the characteristics of compound. Women’s prison punishmentexecution of punishment of criminals, the function of the reform of prisoners. Punishing andreforming prisoners, however, only the means of prison penalty execution, the ultimate goalis to realize the education criminals and others, maintaining social stability.As the prison execution mission development and transformation, and the change of thecriminal characteristics, structure, makes prison education method, mode, managementconcept, hardware and so on in some problems appeared in the process of the transformation,has exposed some archaic and inappropriate understanding and the practice. At present, theprominent phenomenon existing in Chinese women’s prison penalty execution: the intensityof labor is too big; Civil air defense, the authors dimension measures lag; Heavy, light diseasemake rights and interests; Difficult long, short-term punishment cross infection, treatmentsand so on.It should be said that women’s prison penalty execution is a process of gradually matureand perfect. Objectively speaking, the problems faced by the women’s prison penaltyexecution is the problems encountered in the development and progress. The development ofthe society, the progress of The Times, the advancement of the construction of legal system ofsocialism with Chinese characteristics in the judicial system of the prison execution has newconnotation, society of penalty execution play a new role expectations and positioning. In thisbig background, the current women’s women’s prison penalty execution, implementationrequirements and task changes in the status quo. Concrete analysis from the organizationalleadership and work instruction, mainly there are not enough importance, control is notscience, not rigorous, dynamic research is not deep.Therefore, for women’s prison penalty execution problems existing in the process, youfirst need to perfect the technology, such as dimension is infrastructure. Secondly, in theprison execution, in the reform of prisoners when combining labor and rectification,innovation management mode, perfect the layered management mechanism, building themechanism of group psychological education and guidance. At the same time, strengthen theconstruction of the women’s prison guards, improve the quality of the guards, the protectionof the rights of women’s prison guards, we will improve the mechanism of the responsibilityof the women’s prison guards.
