【摘要】 市场经济究其实质就是法治经济，一个健康发展的农村经济是不可能离开健全、完善的法律环境而存在的。农村经济的发展关乎整个国家经济发展的基础，并肩负着近14亿国民的生存重任，因而绝不是农村的区域经济这么简单。改革开放以来，我国农村的经济发展逐步开始了法制化进程，党和政府越来越重视农村经济发展法律环境的重要性。然而，实践中所出现的种种问题，也警醒着我们，农村经济发展的法律环境并未完善。现在许多问题甚至成为了农村经济发展的严重阻碍。而如何完善我国农村经济发展的法律环境，对于促进我国农村地区经济健康、稳定、协调发展，以及构建社会主义新农村具有重大意义。本研究旨在分析清楚当前我国农村地区经济发展所处的法律环境，既包括有利的促进影响，也包括不利的阻碍影响及其表现，并作出整体性评估；以山东省潍坊市寿光为例，具体分析其当前的法律环境，揭示法律环境对其经济发展的影响及产生原因；并针对我国农村地区法律环境的问题，提出具有普遍性意义的完善和改进建议。本文阐明了农村经济发展及法律环境的内涵，论述了有关农村经济发展的相关理论和法律环境理论，对于有关法律与经济的学说进行了分析，阐释了马克思主义经典对于法律与经济发展之间相互关系的分析以及制度经济学、规制经济学、法社会学等理论问题，分析了法律环境对于农村经济发展的影响；对我国农村经济发展的法律环境的发展进行了历史性探究，分析了我国农村地区由最初的人治到政策治理再到依法治理的不断演进的过程，并对于当前我国农村经济发展的法律环境现状进行了探究，揭示了法律环境对我国农村经济发展的正面及负面影响，对当前农村经济发展法律环境进行了总体性评估：认为从整体上来说，我国的农村地区法律环境正朝着良好的方向不断前进，虽然在立法体系上、执法环境上以及法律理念上仍有不足，但是不论国家还是地方政府均对此问题高度重视，农村经济发展法律环境的发展态势是良好的；以山东省潍坊市寿光为实证案例展开了个案分析，对寿光的经济发展状况及法律环境状况进行了细致分析，研究了法律环境对其农村经济发展的促进和阻碍影响，认为寿光地区的农村经济发展之所以如此发达，是与其良好的法律环境密不可分的，法律环境的完善推动了市场经济的发展，为寿光营造了良好的法制氛围，但与此同时，寿光地区在法律体系、司法环境及法律理念方面仍有需要完善的地方，只有解决了这些问题，才能更加好的推动寿光地区经济的持续发展；通过分析、研究之后，根据上述调查结果所显示的农村经济发展的法律环境状况，本文提出了完善我国农村经济发展法律环境的建议和措施：完善促进农村经济发展的相关立法，包括提出对于我国目前问题较为突出的，影响我国农村经济发展的基础法律环境、投资法律环境、民生法律环境中具体法律的制定及完善的建议；构建法制政府，包括打造有限性政府与服务性政府，为农村经济发展保驾护航；维护司法公正，除了制度建设之外，还更要降低法律门槛并主动提供服务；营造良好的农村法律氛围，包括培养农民的守法意识与用法意识；加强法律监督，保障法律的有效实施等。更多还原

【Abstract】 Market economy is the rule of law, their essence economy, a healthy development of therural economy is impossible to leave the sound, a sound legal environment exists. Ruraleconomic development is about the country’s economic development foundation, and nearly1.4billion people entrusted with the production of memory problems, which is by no meansso simple rural regional economic issues only. Since reform and opening, China’s ruraleconomic development gradually began legalization process, the party and the governmentincreasing emphasis on rural economic development, the importance of the legalenvironment. However, in practice the problems that arise, but also alert us legalenvironment for the development of the rural economy has not improved, many questions andeven become a serious impediment to economic development in rural areas. How to improveour legal environment for rural economic development, for the promotion of rural economyhealthy, stable and coordinated development, and building a new socialist countryside of greatsignificance.This study aims to analyze clearly China’s current economic development in rural areasin which the legal environment, including both beneficial impact promotion, includingadverse effects hinder their performance, and make overall assessment; Shouguang, WeifangCity, Shandong Province as an example, detailed analysis of its current legal environment,legal environment reveals the impact of economic development and its causes; and legalenvironment for the rural areas of China ’s problems, propose a universal meaning refinementand improvement suggestions.This paper illustrates the development of rural economy and legal environmentconnotation, discusses the relevant theories of rural economic development and legalenvironment theory, the relevant legal and economic theories are analyzed to explain theMarxist classical writers between the law and economic development relationships and institutional economics, regulatory economics, sociology of law and other theoretical issues,analyze the legal environment for rural economic development; rural economic developmentin our country legal environment to explore the development of a historical analysis of it’sevolutionary process that China’s rural areas from the initial policy governing to governanceaccording to law and the development of China’s rural economy for the current legalenvironment analyzed the current situation reveals the legal environment for economicdevelopment in rural positive and negative impacts of the current legal environment foreconomic development in rural areas of the overall assessment, That on the whole, China’srural areas, the legal environment is moving in a good direction to continue moving forward,although the legislative system, the enforcement of environmental and legal concept is stillinadequate, but regardless of the state or local governments have attached great importance tothis issue, rural economic development, the development trend of the legal environment isgood; Shouguang, Weifang City, Shandong Province case launched a case for the empiricalanalysis, Shouguang ’s economic development and legal environment for a detailed analysisof the legal environment for its rural economic development, promotion and hinder impact,Shouguang area that is so well-developed rural economic development is inextricably linkedto its favorable legal environment, legal environment to promote the improvement of themarket economy, Shouguang create a favorable legal environment, but at the same time,Shouguang region legal system, the judiciary and the legal concept of the environment, thereis still need to be perfected, and only solves these problems, in order to promote more goodShouguang region ’s sustained economic development; in the analysis, after the above findings for rural economic development status of the legalenvironment, this paper proposes a sound economic development in rural areas of China ’slegal environment proposed measures: improving and promoting rural economicdevelopment-related legislation, including recommendations for our current problems aremore prominent, affecting the economic development of rural basic legal environmentinvestment legal environment, legal environment, specific legal livelihood development andimprovement proposals; build legal government, including creating limited government andservice government for rural economic development escort; interests of justice, in addition tosystem construction, but also but also to reduce legal barriers and take the initiative toprovide services; create a good atmosphere of rural law, including the law-abiding farmerscultivate awareness and usage of consciousness; strengthen legal supervision, ensure theeffective implementation of the law and so on.更多还原
