【摘要】 集体林权制度改革的核心就是在不改变集体林地所有权的情况下将林权转移到农民手中,使农民成为林地生产与经营的主体,激发农民的生产生活积极性,从而促进林业的发展。这项改革在社会上引起了强烈反响,被农民群众称为“第三次土地革命”。总体来讲,林地承包权落实到户后,林木承包及经营权将形成四个主要特点：资本性、长期性、物权性及流转性。一方面林权制度改革使大批农民获得了充足的生产资料,彻底解决了农民发展中原始资源或积累难以获取的难题,实现了新农村建设的新思路、新方式；另一方面将会调动农民经营林业的积极性,从而在改善与提升农民生活质量的同时,提升对自然资源的合理利用。此外,可以促进各种生产要素及资本向农村聚焦,从而为实现我国政府所提出的新农村建设打下坚实的基础,实现了自然环境与社会经济协调发展的格局。集体林权制度改革通过确定林权明晰产权,通过林权流转盘活资产,使森林资源在林业资产增长过程中得到增加和优化,林农得到增收。随着集体林权制度改革的深化,昔日沉睡的农村集体林地迅速升值,吸引大量社会资本前来投资,各地涌现了一股“资本入林”热,使林业经济获得空前大发展。近年来,林权流转市场已初具规模,有关问题也大量存在,具体表现为理论层面研究相对薄弱,为实践提供指导的意义非常有限,实践层面流转行为不规范,侵害林农权益的事情常有发生。就湖北省目前流转实践来看,也暴露出一些不容忽视的问题。本文以湖北省集体林权流转作为研究对象,基于对湖北集体林权流转现状分析,总结出集体林权流转纠纷的特点及引发的直接原因；通过影响较大的三个典型案例,指出了湖北省林权流转制度的问题所在,并从立法层面、执法层面及社会服务层面对问题进行了深入剖析；最后,针对存在的问题,提出了完善集体林权流转法律法规的具体措施,希望能够为管理和规范集体林权流转提供建设性意见,从而促进我国林业不断发展。更多还原

【Abstract】 The main content of the collective forest right system reform is on the premise of the collective forest land ownership unchanged, the forest land ownership rights and trees to the farmers, establish the subject status of management, fully mobilize the enthusiasm of the broad masses of farmers to develop forestry. This reform caused a strong reaction in the society, the farmers called "the third land revolution". Contracted to households of woodland and forest ownership has the right to the contracted management of long-term, property rights, capital, and circulation and so on four big features, this make hundreds of millions of farmers not only acquired a lot of production materials and timber assets, and solved the farmers, development of venture capital, financing and other major issues, and realized the breakthrough of rural finance, will greatly arouse the enthusiasm of farmers forestry development, greatly release of forest land, rural labor force and the great potential of forest resources, greatly promote all kinds of factors of production flow to the countryside, for the development of rural economy, the construction of ecological civilization into the strong driving force, to achieve the virtuous cycle of natural ecosystem and social economy system development play a fundamental role.The essence of collective forest right system reform is the determination and transfer of forest rights, by determining forest right clear property rights, to revitalize the assets through forest right circulation, make the forest resources in the process of forestry asset growth had increased and optimization, increase forest. As the collective forest right system reform deepening, the former rural collective forestland rapid appreciation of the sleeping and attract a large number of social capital investment, have sprung up around a hot "capital into the forest", the forestry economy get unprecedented development. In recent years, the forest right circulation market has preliminarily established, however in the theoretical research and practice of collective forest rights circulation has many problems, the specific performance for the theoretical research is relatively weak, to provide practical guidance significance is very limited, practical level circulation is not standard, the violation of flow related to the main body of forest rights often happen. The practice circulation, Hubei province, also exposed some problems that nots allow to ignore. This paper, taking Hubei province as the research object of collective forest rights circulation, based on the analysis about the present situation of collective forest rights circulation of Hubei province, summarizes the characteristics and the cause of the circulation of collective forest rights dispute directly; Through the influence of three typical cases, points out the problem in the system of Hubei province forest right circulation, and from the aspect of legislation, law enforcement level and the social service level makes a deep analysis of a problem; Finally, in view of existing problems, and puts forward the legal countermeasures of perfecting the system of collective forest rights circulation, in order to regulate the circulation of collective forest rights, to promote the harmonious development of the ecological forestry and the forestry of the people’s livelihood.更多还原
