【摘要】 随着社会经济的迅猛发展,人们思想观念和生活方式的转变,一种新的生活方式---非婚同居在世界范围内日趋增多,无论从思想观念还是数量上,非婚同居的家庭模式已经能够和传统婚姻家庭分庭抗礼了。我们国家传统的婚姻制度也正经历着从未有过的洗礼,长期以来,由于传统的婚恋观和道德等因素,决定了走向婚姻与性生活的唯一桥梁就是当事人双方缔结婚姻,但是非婚同居的出现,使得家庭关系多元化,对于这一现象的出现虽然有其合理性,但无疑引发了很多的社会问题,因此我们要辩证的去对待它的存在,才能做到趋利避害。本文的基本观点是,对于非婚同居问题法律应当辩证的去对待它的存在,且要对其进行相关的立法来规制当事人之间的权利义务,特别是要针对当同居关系终止时财产如何分割做出明确的规定。为此,本文分五章对其进行论述。第1章对非婚同居的含义、特征、类型及非婚同居关系财产的特点进行一般的介绍,为本文的写作进行了必要的铺垫。第2章对我国关于非婚同居关系财产的现行法律及司法解释进行梳理,从中可以看出我国现行法律及司法解释对非婚同居关系财产进行规制的不足。第3章对两大法系中有关非婚同居关系财产的相关规定进行归纳总结,然后进行比较,找出适合我国现阶段非婚同居关系财产处理的立法经验,借鉴其有利之处。第4章列举出我国在立法和实务方面存在的不足,以期在以后的立法中可以更好地完善。第5章从确立非婚同居关系财产应遵循的基本原则和相关的制度建议来构建我国对非婚同居关系财产分割的法律制度。更多还原
