【摘要】 公平正义，是人类千百年来不懈追求的美好愿望，是人类社会永恒的价值追求。从某种意义上来说，人类社会历史的发展就是广大人民群众不断追求公平正义的历史。简单来说，公平正义是公平、公正、平等、和谐、正义等概念的集合体。当前中国各种社会矛盾丛生，其中，为了生产、生活的需要，人类与饲养动物接触的机会也越来越多，饲养动物在给人类带来了很大的便利的同时，对人类造成的伤害也越来越多。虽然我国新颁布的《侵权责任法》对动物致害责任作了专门的规定，然而由于该法实施时间尚短，相关法律制度也没有完全确立，很多法律条文在具体司法实践中仍存在争议。本文试图通过对饲养动物致害制度的论述介绍，指出我国目前立法中的不足之处，并结合我国国情提出完善建议，最终在饲养动物致害责任立法完善过程中实现公平正义的价值追求。论文共有六个部分。第一部分主要介绍本文的研究背景和意义、研究范围和方法；第二部分介绍“动物”在生物学上的概念，随之总结了饲养动物从古代法到当代法的发展变化，然后介绍我国现行法的相关规定；第三部分为饲养动物致害责任的概述，讨论了我国饲养动物致害责任的归责原则、承担主体、构成要件以及免责事由；第四部分通过对我国饲养动物致害责任立法现状的介绍，揭示其中存在的一些具体问题；第五部分针对我国饲养动物致害责任立法中存在的问题提出完善建议；第六部分结合前文介绍，阐述完善我国社会主义法律体系中部门立法，不仅有利于我国社会主义法治建设，而且有利于促进社会和谐、实现公平正义。更多还原

【Abstract】 Fairness and justice is the good wishes unremitting pursued by human for onethousand years and the permanent pursuit of value by human society. To some extent,the development of human social history is the history that people constantly pursuethe fairness and justice. In simple terms, fairness and justice is the aggregation offairness, justice, equality, harmony, just and so on. When all kinds of socialcontradictions in China are present, in order to product and live, humans haveincreasing opportunities to contact with animals. It brings great convenience to humanbeings, while there is more harmness to us. Although our country newly promulgatedthe "Tort Liability Law" to rule the damages caused by animals specially. However,the related legal systems is not well-established because of the short period of this lawimplementation. Many laws remain controversial in the concrete judicial practice.This article attempts to point out the deficiencies in Chinese current legislationthrough the introduction of the responsibility of causing damages for feeding animalssystem, and puts forward improved suggestions in combining with Chinese nationalconditions. Finally, the value pursuit of justice is realized in the process of theperfective legislation of the responsibility of causing damages for feeding animals.The article consists of six parts. The first part mainly introduces its researchbackground and significance, research scope and methods. In the second part, itintroduces the concept of the "animal" in biology, and then sums up the developmentand changes of feeding animals law from the ancient to contemporary, and thenintroduces the relevant regulations of existing law. The third part is the overview ofthe responsibility of causing damages for feeding animals, which discusses theimputation of liability, the subject, constitutive requirements and reasons for relief ofit in our country. The fourth part reveals some existing problems through theintroduction of present legislation to the responsibility for damage caused by theanimals in our country. The fifth part makes suggestions for the existing problems inthe legislation of the responsibility of causing damages for feeding animals. The sixthpart combines with the above introduction in this paper, to illustrate the DepartmentLegislation in our socialist legal system, Which is not only beneficial to Chinese socialist rule of law, but also to promote social harmony and realize the fairness andjustice.更多还原
