【摘要】 刑事强制医疗制度是我国刑事诉讼特别程序的重要组成部分,它的确立和实施对于法治国家的建设和人权保障的实现具有重要的意义。作为一种社会防卫措施,刑事强制医疗制度通过对依法不负刑事责任的精神病人的强制隔离和治疗,消除了社会中的不稳定因素,保护了公民的人身财产安全,维护了良好的社会生活秩序。作为一种人权保障措施,刑事强制医疗制度通过科学严密的程序设置和运行机制,适当约束了裁判者的自由裁量权,保护了被强制医疗者的合法权益,确保了裁判结果的公正性。本文从以下四个部分对我国的刑事强制医疗制度进行了全面而深入的探究。本文第一部分是有关的基本理论部分,这一部分主要探究了概念、特征以及价值等相关的刑事强制医疗制度的基本知识。本文第二部分是关于域外刑事强制医疗制度的考察,这一部分主要介绍了域外在相关制度方面的先进经验,并归结出域外刑事强制医疗制度具有防卫社会与保障人权并重、主动干预与被动审查并重以及司法机关主导与医疗机构辅助并重的特点,借鉴这些先进经验对完善我国刑事强制医疗制度具有重要的意义。本文第三部分是我国刑事强制医疗制度的现状及缺陷,这一部分主要介绍了我国目前刑事强制医疗制度的法律规定及其实施情况。通过与域外相关制度进行比较分析,阐明了我国刑事强制医疗制度存在的许多不足：适用对象过于狭窄,未能包括限制刑事责任能力的精神病人以及其他应当适用刑事强制医疗措施的人员；适用条件不当,将保护对象限定为公共安全和公民人身安全,难以实现对所有法益的全面保护；程序可操作性不强,难以有效的保护当事人的合法权益。本文第四部分是完善我国刑事强制医疗制度的建议,该部分针对我国的实际情况,提出了一系列完善我国刑事强制医疗制度的构想。首先是适当扩大适用对象范围,科学确定适用条件,其次是完善相关的程序设置,最后是完善相关的配套措施,从而充分实现刑事强制医疗制度防卫社会和保障人权的价值追求。更多还原

【Abstract】 The criminal compulsory medical care system is an important part of our special criminal procedure, the establishment and implementation of it has great significance for the realization of the country’s construction of the rule of law and protection of human rights. As a social defense measures, the criminal compulsory medical care system through compulsory isolation and treatment of mental patients in accordance with the law is not criminally responsible, eliminating the factors of instability in society, protecting personal and property safety of citizens, maintaining a good social life order. As a human rights safeguards, the criminal compulsory medical care system through a rigorous scientific process and running mechanism, properly restrain the judge’s discretion, protecting the legitimate rights and interests of the compulsory health, ensuring the referee fairness of the judgment.In this paper, I will give a comprehensive and deep exploration about the criminal compulsory medical care system from four parts.The first part is on the basic theory. In this part, I mainly explain the basic knowledge of criminal concept, characteristics and the value of the relevant compulsory medical treatment system.The second part is about the extraterritorial criminal system of compulsory medical treatment. In this part, I mainly introduces the advanced experience in the related system of extraterritorial, and concludes the characteristics of defending the society and guaranteeing human rights, both passive and active intervention and review, and with the characteristics of both the judicial organs leading medical institutions and auxiliary in the extraterritorial criminal system of compulsory medical treatment. It has great significance for us to study the advanced experience for the perfection of China’s criminal compulsory medical system.The third part is about the present situation and defection of our criminal compulsory medical care system. In this part, I mainly introduce the current legal provisions of the criminal compulsory medical care system in our country and its implementation. By comparing with foreign related system, illustrating many deficiencies in China’s criminal compulsory medical system:applicable object is too narrow, failure to include limited criminal responsibility of the mentally ill and other compulsory medical measures should apply to criminal; improper applicable conditions, the object of protection is limited to public safety and the citizens’ personal security, it is difficult to realize the full protection of all legal interests; program operability is not strong, it is difficult to protect the legitimate rights and interests of the parties effectively.The fourth part is about the suggestion of improving the criminal compulsory medical system. In this part, according to the actual situation, I put forward a series of perfect idea about completing the health care system. First, it is appropriate to expand the scope of the applicable object and scientifically determine the applicable conditions. Second, it is necessary to improve the procedure. Finally, in order to fully realize the value of the pursuit of criminal defense of society and the protection of human rights, it is necessary to complete the supporting measures of the health care system.更多还原
