【摘要】 植物人是指因脑颅损伤、疾病或先天畸形等原因导致脑部伤害，进而陷入植物状态的患者。植物人无认知能力及自主行为，作为无行为能力之民事主体需相应行为能力补正制度加以调整。陷入持续植物状态的植物人需有相应终止救治机制满足植物人的先前意愿，维护其临终尊严。我国存在相当数量植物人，至今仍未有系统的法律调整模式，上述问题皆未能解决。本文针对该问题设置一套系统的植物人法律调整模式。文章遵循植物人从植物状态——持续植物状态——永久植物状态的病情发展为线索，设立一套使用所有植物人及其不同病情发展阶段的法律调整模式。第一部分旨在阐明植物状态的病理特征，并论证为植物人设立系统法律调整模式之必要：植物人为行为能力欠缺之民事主体，须为其设立行为能力补正制度。更须有相应法律调整其与家属、社会间的关系。为全文论证奠定基础。第二部分对陷入植物状态的患者设立行为能力补正制度：摒弃繁琐机械的行为能力认定前置程序，直接将植物人纳入监护范围；引入意定监护制度；并应针对植物人监护的特点在监护监督、监护人范围、监护人权利义务方面进行调整，以满足植物人监护的需要。第三部分探讨为陷入持续植物状态患者设立终止救治制度之可能。从现有植物人终止救治制度的理论基础出发，确认植物人终结救治是为了维护植物人的临终尊严。并在此基础上引入尊严死概念，从其立法例、基础要素进行综合分析，得出我国当前不适合引进尊严死的结论，应设置一套较为成熟且缓和的制度作为植物人终止救治的立法模式。第四部分介绍了临终关怀制度的概念和特征，并从理论和现实角度阐明兼容植物人护理的可能性。在此基础上论证了临终关怀机制优于尊严死，最后构建了与临终关怀制度衔接的缓尊严死，作为我国现今植物人终结救治机制的选择。并主张将其立法作为未来尊严死的雏形。更多还原

【Abstract】 Vegetables are the patients in vegetative state because they suffer the brain injury,skull injury, disease or congenital malformations and other reasons. As beingincapacitated and lacking the cognitive ability and autonomous behavior, vegetablesare required for Capacity compensation to regulate. The patients who are in persistentvegetative states, need the corresponding termination of the treatment mechanism tomeet their previous willingness and maintain their dying dignity. There are aconsiderable number of vegetables in our country. Due to that systematic legaladjustment mode does not exist, the above problems are not settle down yet. Theauthor of this thesis, attempt to set up a system of adjustment mode for vegetativestate law.Based on the clue of the progression of vegetative state,including vegetativestate-persistent vegetative state-a permanent disease,the author set up a legalregulation model applying to all stages of development in the vegetative state andtheir different conditions. The first part focuses on clarifying the pathological featuresof the vegetative state, and demonstrates the necessity for the establishment of asystem of legal adjustment mode for the vegetative state: As being incapacitated andlacking the cognitive ability and autonomous behavior, vegetables are required forCapacity compensation to regulate. A corresponding legal regulation must beestablished to regulate the relationship among the relatives as well as society. All ofthose discussed above play the foundation role for full-text argument.The second part discussed the establishment of capacity compensation to for thevegetables: it is necessary to abandon the cumbersome machinery of the capacityidentified pre-program,then to extend the custody range to a vegetable and introducethe durable power of attorneys. Apart from that, it is also necessary to emphasize theadjustment in the custody supervision guardian range, the guardian of the rights andobligations according to the characteristics of the vegetative state custody,aiming atmeeting the needs of the vegetative custody.The third part probes into the possibility of the regulations abouttreatment-limiting decision. Based on the theory of treatment-limiting decision for thevegetables, the author believes that treatment-limiting decision maintains thevegetable’s dignity of death. Firstly, the author introduce the concept of dignity ofdeath, analyzes the cases and the basic elements of death with dignity, and thendraws a conclusion that our country is not suitable for the introduction of the Dignityof Death but shall set to the legislative model of a more mature and ease of the systemas the regulation of treatment-limiting decision.The fourth part introduces the concept and characteristics of the hospice system,and clarifies the possibility of combining the vegetative state care and the hospicesystem from the theoretical and practical perspective. Based on this argument, theauthor holds a view that the hospice mechanism is superior to the death with dignity,building a slow death with dignity which is connecting with hospice system as thechoice of treatment-limiting decision for vegetables in our country.
