【摘要】 随着全球一体化进程的加快，跨界人员流动和各种形式的人员交往越来越频繁。在此背景下，国际非传统安全因素的涌现、局部冲突的此起彼伏、社会治安状况的不稳定以及自然灾害等天灾人祸的综合作用，对海外公民的安全造成了很大的威胁和损害。“走出去”战略实施以来，海外中国公民安全的保护问题引起了空前的关注。海外安全事故频发，促使我们反思目前公民海外安全保护的机制，对新时期的外交工作提出了新的课题和挑战。本文分为五章：第一章主要分析海外中国公民和利益的构成，界定海外中国公民和法人，归纳总结海外中国公民遭遇的主要安全威胁类型，并分析这些威胁产生的原因。第二章从海外公民安全保护的类型出发，探讨国际法关于海外公民安全保护的理论问题，立足国家与公民的关系，阐述国际法关于外国人待遇和管辖的理论，结合国际法的人本化趋势和现代企业社会责任理论，对海外公民安全保护进行理论分析。第三章考察明清以来海外中国公民安全保护的历史沿革，总结历史上我国海外公民安全保护的特点，分析当前我国海外公民安全保护的现状及其主要问题。第四章从比较法的视角，介绍以美国和日本为代表的海外公民安全保护机制。第五章在前文的分析研究基础上，对完善我国海外公民安全保护机制提出意见和建议。更多还原

【Abstract】 As the process of global integration speeds up, personnel exchanges as well as thecommunications between different countries and areas are becoming more and morefrequent. However, under these circumstances, the emergency of non-traditional securityfactors, local conflicts, uncertain social conditions and nature disasters, etc. cause muchthreat and damage to citizens overseas. The security of Chinese overseas has drawn plentyof attentions ever since the implementation of the "going out" strategy. It urges us toreview our systems toward the protection of overseas citizens as the growing occurrenceof overseas security accidents, which puts forward new challenges and tasks to diplomacyin the new period.This thesis is divided into five chapters：ChapterⅠmainly analyses the consistent ofoverseas Chinese citizens and interests, define the scope of Chinese citizens andcorporations, summarizes major threats overseas Chinese face, and try find out the causes.ChapterⅡstarts from basic academic classifications of overseas citizen protection, takes adeep look into the theories of overseas citizen protection in the international legal,expounds the theories of foreigner treatment and administration, and introduces otherfundamental theories based on the trend of humanization of international law and thejudicial practice in China. Chapter Ⅲ observes and studies overseas Chinese citizenprotection in the history since late Ming Qing Dynasty, suspects the current situation ofoverseas citizen protection and its defects. Chapter Ⅳ, taking examples for the US andJapan, introduces the systems of overseas citizen protection in developed countries, whichmay provide some inspirations to China. In the end, ChapterⅤputs forward feasiblesuggestions as to perfect the overseas protection system in China.更多还原
