【摘要】 我国是一个文化大国,拥有着数量十分丰富的文化遗产,这其中最具有代表性的当属文物遗产。但是我们还不是一个文化强国,突出表现在对文物的法律保护的不健全,导致文物破坏以及文物犯罪活动呈现出嚣张态势。依法治国首先要求就是要有法可依,之后才能做到有法必依、违法必究、执法必严。我国目前已经形成了一个由文物保护法和刑法相互配合的文物法律保护体系。刑法在文物保护中的作用非常独特和重要,但由于我国法制建设起步晚,经济发展速度迅猛,新情况新问题层出不穷,文物犯罪日益猖獗,文物利益侵害程度不断加深,立法的僵硬性和漏洞也日趋凸显,不利于我国文物的保护。本文就文物的界定和文物立法的现状,分析我国文物犯罪刑事立法中存在的问题。从我国历史上对文物的界定,探讨文物的渊源。通过对现行文物立法的解读来发现存在的抽象和具体问题。针对症结提出自己的看法,为我国文物立法的完善提供建设性意见,以此达到健全文物立法预防文物犯罪保护祖国文化遗产的目地。更多还原
