【摘要】 数字图书馆是指一种服务机制,拥有内容的丰富、多种媒体相结合的数字化信息资源,能为用户便捷地提供信息的服务。更简单地说,它是连接通过网络相互连接的空间“或”信息空问“是一个管理和使用数字信息的空间,而不是一个定义为物理位置的传统的图书馆。它有传统图书馆的文献资源,还具有更新,链接外部信息源数字化整合数据,并存储管理等功能。由于数字信息在传播、存储等方面的特征,使图书馆服务向自动化方面发展,这使使数字图书馆建设中的著作权保护这一问题日益突出。随着国民经济的快速发展,电子商务,网络信息技术,数字化作品和网络通信的作品给用户带来了前所未有的便利,但同时,由于网络环境的开放性、交互性、技术性、便捷性等特点,使侵犯网络著作权大量增加、隐蔽且成本低廉,导致网络著作权侵权现象日益严重,给著作权人的权益的保护带来了极大的障碍。著作权法的本质就是平衡著作权人和用户的利益,而数字图书馆建设中的合理使用制度正是体现了这种理念。由于网络环境的特殊性,在网络环境下著作权的权利保护困难重重,尽管世界各国采用相应的对策保护网络著作权,但是许多问题仍需要达成共识的基础上,立法机关或司法机关通过司法解释的形式予以解释。为了提供有效的保护著作权在数字图书馆的建设环境当中,本文意在针对我国网络环境下著作权保护中存在的主要问题进行了探讨,从法律上、技术上、管理上采取相应的措施以解决这些著作权问题,切实实现资源共享,并提出了予以完善的建议。更多还原

【Abstract】 Digital Library is a service mechanism, content rich, multi-media combination of digital information resources, users can easily provide information services. More simply, it is connected by a network of interconnected space "or" information space "is a management and use of digital information, rather than a physical location defined by the traditional library. It has a traditional library resources, updates, links external source of information for the digitized data integration, storage management, and other functions. Digital information dissemination, storage, and other characteristics, the form of library services into automation, this shift from counter-service to copyright protection in the digital library construction this issue have become increasingly prominent.With the rapid development of e-commerce, network information technology, digital works and network communication to the users of works brought unprecedented convenience, but at the same time, due to the openness of the network environment, interactivity, technical, convenience and other characteristics, network copyright infringement simple, hidden, and low cost, leading to the phenomenon of network copyright infringement highlight many forms, has brought great losses to the interests of the copyright owner. Network copyright infringement in the emergence of some new problems and new characteristics of traditional copyright laws and regulations also had a huge impact.The essence of copyright law is to balance the owner of the copyright in the public interest, and the rational use in the construction of digital library system is a manifestation of this idea. Due to the special nature of the network environment, the judicial protection of copyright in the network environment often suffers, despite the world to take corresponding countermeasures copyright protection for the network, but many issues which need to reach a consensus on the basis of depth, the urgent need for legislation authority or judicial authority through legislative or judicial interpretation in the form described.In order to provide effective protection of copyright in the digital library construction environment, the paper aims to explore the main problems of copyright protection under the network environment in China, from the legal, technical, management take the appropriate measures to address these copyright problem, the practical realization of resource sharing, and propose recommendations to be perfect.更多还原
