【摘要】 法官弹劾制度是司法制度的重要组成部分，也是法官身份保障制度之一，目前我国并没有法官弹劾制度，然而现存的法官罢免制度仍存在诸多缺失之处，本文力求在借鉴国外先进立法经验的基础上对我国构建法官弹劾制度的理论和实践的可行性进行分析，特别是对英美法系的美国的法官弹劾制度、大陆法系的欧洲国家德国和亚洲国家日本的法官弹劾制度进行比较分析，借鉴国外法官弹劾制度的有益成分，在构建适合我国国情的法官弹劾制度的道路上做出有益的探索。首先，本文全面梳理了弹劾的理论问题，特别是法官弹劾制度与法官惩戒制度的区别和联系，为更好地进行制度选择做准备。司法监督和权利救济是法官弹劾制度的主要功能，其制度意义主要是维护司法独立、规范法官行为、抑制司法腐败、保障法官的合法权益；其次，本文详细分析了美国、德国、日本的法官弹劾制度，美国是典型的英美法系国家，又是对英国弹劾制度借鉴吸收较好的国家，因此成为我们分析的对象。德国和日本虽然都是大陆法系国家，但法官弹劾制度仍有较大区别，对我国法官弹劾制度构建意义重大；再次，从我国法官罢免制度的现状到法官弹劾制度在我国的可行性分析，全面阐述了我国法官弹劾制度构建的相关条件，进而得出在我国目前的现有制度中，通过对人大建筑机制的完善，构建我国特色的法官弹劾制度的结论；最后，通过严谨的分析与研究，在确立我国构建法官弹劾制度的基础上，详细阐述了我国构建法官弹劾制度的理念、原则及具体制度的设计，以期达到构建我国特色的法官弹劾制度的目的。更多还原
