【摘要】 伴随着我国计划经济向市场经济的转型,城乡规划不再是一种“自上而下模式”单纯的技术手段,城乡规划的公共政策属性决定了它的社会性、开放性和互动性。城乡规划需要对各种利益关系进行协调,城乡规划的合理与否与各利益关系人息息相关,也关系到社会经济能否健康稳定地发展。当前,人们对城乡规划公众参与的必要性和重要性的认识已取得相当的共识,我国新的城乡规划法区别于原城市规划法的重要内容之一就是提出城乡规划的公开化和建立公众参与制度的要求。台州市在城乡规划实践中已经建立起政府信息公开制度、规划公示制度、规划听证会制度等有关公众参与制度,城乡规划各环节中公众参与的对象、范围、组织和权利义务等内容也通过相关制度进一步明确,社会公众获取政府信息、了解规划情况和表达意见的渠道也逐步建立。本文通过对台州市城乡规划公众参与实践的分析表明,现阶段的城乡规划公众参与还存在参与效果不佳等问题,需要进一步完善城乡规划公众参与制度。本文主体分三个部分：第一部分简述我国当前城乡规划背景,指出城乡规划公众参与必要性,在此基础上提出本研究的意义、方法、内容及研究的框架。第二部分：介绍国内外城乡规划公众参与的理论和相关研究内容,阐述发达国家和地区的城乡规划公众参与制度和主要特点,并对我国公众参与制度进行简要分析,提出发达国家和地区的公众参与制度值得借鉴之处。第三部分：对台州市近年来的城乡规划公众参与制度建设进行阶段性的总结和分析,结合台州市城乡规划制定和实施中的案例研究,分析当前城乡规划中公众参与存在的问题及问题产生的原因,有针对性地探讨如何避免公众参与形式化,推进真正的实质性参与。城乡规划公众参与制度建设的目标是实现“阳光规划”,这种制度的理想状态是寻求一种城乡规划决策的透明机制,建立城乡规划领域平等、公开、开放的参与制度。而其路径就如同本文论述,要从提高城乡规划公众参与的有效性出发,进一步完善各项公众参与制度的内容和程序,并建立起健全的公众参与制度体系。更多还原

【Abstract】 Along with the switch from planned economy to market economy, the urban and rural planning is no longer a purely "top-down" technical means. The urban and rural planning public policy attribute determines its social nature, openness and interaction. So it needs balance the relations among various interests; the urban and rural planning, which is designed well or not, is closely bound up with interested parties and has a bearing on whether the social economy can develop soundly and steadily or not. At present, we have reached a considerable consensus on the necessity and importance of public participation in the urban and rural planning. The openness of the urban and rural planning and the requirement for establishing public participation system have been pointed out by Urban and Rural Planning Law, which came into force as of January1st,2008. Governmental information disclosure system, the system of keeping the public informed, and hearing system, which are related to public participation system, have been established during the practice of the urban and rural planning in Taizhou. Meanwhile, some contents in the process of the urban and rural planning, such as the object, scope, organization, and rights and obligations of public participation, have been further clarified through the relevant systems. The various channels which the public can get governmental information, understand the planning, and express their own opinions, have been gradually built up. However, through the analysis of the practice of public participation in Taizhou urban and rural planning, this paper showed that some problems still exist at present, for example, the effectiveness of participation has not achieved satisfying result. Thus the system of public participation of the urban and rural planning should be further improved.The paper consisted of three parts:Part one sketched the background of current urban and rural planning, pointed out the necessity of public participation of the urban and rural planning, and presented the significance of the study, the methods, the contents and the framework of the study based on the brief introduction.Part two introduced related theories and studies of public participation of the urban and rural planning at home and abroad; described systems and main features of public participation of the urban and rural planning in the developed countries and areas; then analyzed briefly the system of public participation in China; finally put forward the merits of the system of public participation in the developed countries and areas that we can learn Part three summarized and analyzed the recent establishment of public participation of the urban and rural planning in Taizhou in the phasic sense; analyzed the problems existed and reasons caused about public participation during the current urban and rural planning based on the case studies in the establishment and implementation of the urban and rural planning in Taizhou; probed into how to avoid public participation becoming a mere formality and eventually make public participation true substantive.Urban and rural planning public participation system is to achieve the "Sunshine Planning". The ideal state of this system is to seek for a transparent mechanism of policy making in the urban and rural planning, and set up the equal and open public participation system in the urban and rural planning. As discussed in this paper, the effectiveness of public participation of the urban and rural planning should be enhanced; the contents and procedures of the public participation system of the urban and rural planning should be improved; and a sound system of public participation should be established.更多还原
