【摘要】 在中国传统法律文化的诸多表现形式中,人民群众出于朴素的对公平、正义的追求和表达自身意愿诉求,对能够代表自身意愿、有极强能力、不畏强权与恶势力、清正廉洁的“清官”有着一种明星崇拜式或者图腾式的渴求与信任,表现出一种浓厚的“清官情结”。这种情节作为一种文化根深蒂固的存在于现实之中,影响着不仅在司法活动中影响着当事人双方、影响着司法审判人员,也影响着行政、社会舆论等社会诸多方面,这些都共同对法治理念在社会各个层面的贯彻落实有着直接的影响,这种情况是当前社会管理体制改革和司法活动过程中不能忽视的一种民意的基础和社会现实,也是对我们更好的进行司法活动、贯彻落实社会主义法治理念不可忽视的法律文化基础和国情基础。对此进行研究试图通过对“清官情结”的人治本质及其对现代法治理念、司法行为的影响进行的利弊正反两方面进行分析,对这一传统法律文化中的思想内涵进行批判性的继承,以此作为一个传统法律文化与现代法治理念之间关系及相互借鉴的范例,使得我们能够真正的研究人民群众需要什么样的法治理念以及在这种法治理念指导下进行的司法行为,特别是人民群众对法院人员及其司法行为的要求,如何在现历史阶段的社会物质、文化条件下真正贯彻法治理念。更多还原

【Abstract】 In the Chinese traditional legal culture in many forms, from simple people to justice, pursue and the expression itself will demand, on their own, can represent a strong ability, fear of power and the evil forces, uncorrupted " official " has a kind of star worship for totem type or craving and trust, showing a strong " complex of honest and upright official ". This storyline as a culture ingrained in reality, affecting not only in the judicial activity in the affected parties, affect the judicial personnel, also affects the administrative, public opinion and other social aspects, these are common on the idea of rule of law in all levels of society to implement has a direct impact, this situation is the current reform of social management system and judicial processes cannot be ignored in a public foundation and social reality, but also for our better judicial activities, carry out the socialist concept of rule of law can not be ignored the legal culture foundation and basic conditions. This study attempts to " honest and upright official complex" rule of nature and the modern concept of the rule of law, judicial behavior are the pros and cons of positive and negative two aspects carries on the analysis, the traditional legal culture of the ideological connotation of critical inheritance, as a traditional law culture and modern rule of law concept and relationship between each other paradigm, so that we can truly research people need what kind of idea of rule of law and the concept of the rule of law under the guidance of the judicial action, especially the people to the officer of the court and its judicial act requirements, how at this stage of the history of social material, culture conditions to really implement the concept of rule of law.更多还原
