【摘要】 刑事抗诉是法律赋予检察机关刑事审判法律监督的重要手段,加强刑事抗诉工作既是实现“强化法律监督,维护公平正义”检察工作主题的必然要求,也是落实“加大工作力度,提高执法水平和办案质量”检察工作总体要求的重要措施。近几年来随着A省检察机关刑事审判监督工作力度的不断加大,A省的刑事抗诉工作取得了一定的进展,但是在实际工作中,由于受到种种因素的制约,抗诉工作仍然是基层公诉工作的一个难点。本文通过对2008-2010年度A省检察机关刑事抗诉情况进行调查分析,查找了该省刑事抗诉工作中存在的案件质量不高、案件类型单一、地区间发展不平衡、案件总量偏低、质量不高等诸多问题。分析其成因,这既有法律制度层面的原因,也有工作机制层面的因素,更与检察人员的主观认识偏差密不可分。要进一步深入开展刑事抗诉工作提高工作质量,一方面要使相关的法律法规进一步明晰,增强实际工作的可操作性；更重要的是优化检察机关内部的相关工作机制,提高检察机关自身法律监督工作能力,确保刑事抗诉作为审判监督的重要手段,真正发挥其主力军的作用,切实保障法律的统一正确实施,维护司法公正,促进社会和谐稳定；同时,对法院的相关工作机制也要进行相应的改进。距离新修改的刑诉法实施还有两个多月的时间,相关配套的法律法规正在修改当中,这对A省的刑事抗诉工作是机遇也是挑战,要抓住这一有利时机,切实推动刑事抗诉工作更上一个台阶。更多还原

Analyzing the causes, which is not only legal system level reason, also have work mechanism level factors, more and procuratorial personnel’s subjective cognition deviation are inseparable.
