【摘要】 何为行政程序违法?这是人民法院在审查行政程序违法案件时要首先面对的问题。随着理论和实践的深入发展,行政程序违法的内涵也经历了一个变化过程。《行政诉讼法》颁布之初,受《行政诉讼法》第54条规定的影响,一般认为行政程序违法是指行政机关“违反法定程序”,即行政机关实施行政行为违反法律、法规规定的方式、形式、手续、步骤、时限等。随着“正当法律程序”的引入和阐述,行政程序违法的内涵也在发生变化,行政程序违法不仅指行政主体实施行政行为违反法定的程序规则,也指行政主体实施行政行为违反正当程序原则。无论是违反法定的程序规则,还是违反法定程序原则,都构成程序违法。所谓正当程序是指基于公平、正义而应遵循的程序,不论法律是否有明确规定都应予以遵守,它是对行政主体行使行政权力的最低限度的程序要求,已成为许多国家司法审查的重要原则。法律责任是对法律关系主体违反法定义务的否定性评价,它要通过多种责任形式表现出来。一般认为,行政程序违法的法律责任包括无效、撤销、补正、责令履行职责、确认违法、行政赔偿等形式。此外,行政公务人员也是程序违法的责任主体,也应当承担相应的法律责任。我国的行政主体程序违法的法律责任主要规定在《行政诉讼法》、《行政复议法》、《行政处罚法》、《行政许可法》及其他法律、法规和规章之中。对行政程序违法及其法律责任进行司法认定,是人民法院在审查行政程序违法案件过程中的一个重要任务。区分程序瑕疵和程序违法对于准确区分二者的法律责任,实现发挥行政诉讼法监督行政机关依法行政、保护相对人合法权益的职能至关重要。本文从程序违法及法律责任的概念入手,探讨不同程序违法行政行为的处理方式,以及如何区分程序瑕疵和程序违法,并最终确定其法律责任。更多还原

【Abstract】 What is the illegal administrative procedures? This is the people’s court review in administrative procedure illegal case to first face problems. With the further development of theory and practice, administrative procedures illegal connotation also experienced a changing process."Administrative procedural law" at the beginning of the promulgated by the administrative procedure law, the provisions of article54of the influence, it is generally thought that the administrative procedure law is refers to the administrative organ "in contrary to the legal procedures", namely administrative organs to implement administrative behavior violates laws, rules and regulations way, form, procedures, procedures, time limit, etc. With the "due process of law" and the introduction of the paper, the connotation of the administrative procedure law also is in produce change, administrative procedure law not only refers to the administrative subject to implement administrative behavior violates the legal rules of procedure, also refers to the administrative subject to implement administrative behavior in violation of the principle of due process.Whether in violation of legal rules of procedure, or in violation of legal procedure principle, constitute a program illegal.[1] the so-called due process refers to the fair, justice and based on should follow the procedures, no matter whether the law have specific provision should be abide by, it is the administrative main body the exercise of administrative power minimum program requirements, many countries has become an important principle of judicial review.Legal liability is the legal relationship of main body violation of statutory obligations negativity evaluation, it is expressed through a variety of responsibility. Generally, the administrative procedure law legal liability including invalidation, cancellation, compensating, shall be ordered to perform their duties, confirm the illegal and administrative compensation form. In addition, the public personnel is also program illegal responsibility main body, also shall bear the corresponding legal liabilities. China’s administrative subject program illegal legal responsibility the main provisions in the administrative procedure law, the administrative reconsideration law, the law on administrative penalty and the administrative license law and other laws, regulations and rules in.The administrative procedure law and the legal responsibility the judicial recognition, is the people’s court in review administrative procedure in the process of illegal cases is an important task.
