【摘要】 专利制度对一个国家的经济发展和科技进步起到非常重要的作用。如何充分利用和发挥专利权的价值,对以科技强国为目标的中国来说,是一项重要课题。专利权质押是利用知识产权进行融资融信的重要方式,我国在《担保法》、《物权法》中均已明确规定了专利权质押制度,但在实践中专利权的申请数量和质押数量相差甚远,这说明在实务操作中,专利权质押制度存在诸多不足和需要努力完善之处。在此种背景下,研究专利权质押制度具有重要的理论和实践意义。本文从四个方面对专利权质押制度进行论述。第一部分专利权质押的基本概念,探讨了专利权质押与其他担保行为的区别,分析了专利权质押的特征和功能。第二部分我国专利权质押制度的现状,从实践角度分析了专利权质押制度目前面临的问题。第三部分对域外专利权质押制度进行考察,包括美国、英国和日本的特殊制度及对我国的借鉴作用。第四部分根据之前的论述和分析,探讨了我国专利权质押制度的发展前景,同时针对其面临的问题提出改善意见。最后对全文进行了简要总结,并指出了今后进一步研究的方向。更多还原

【Abstract】 The development of national economy and science and technology progress has played a very important role.How to make full use of and the patent right’s value to play with science and technology power,for Chinese,it is to target an important topic.Patent pledge is the use of knowledge property rights is an important way to margin letter,our country in assurance law and property law has been specified by the patent right of pledge system,but in practice patent application number and pledge quantity,suggesting that far in practical operation,patent pledge system exists many deficiencies and need to make great efforts to perfect place.In this context.study patent pledge system has important significance in theory and practice.This article from four aspects of the patent pledge system were discussed.The first part introduces the basic theory of patent pledge.It discribes the concept and nature of patent pledge,the difference betweeen patent pledge right and other pledge right and the particular provisions of patent pledge.The second part from the perspective of legal and policy describes the present situation of China’s patent pledge, from the perspective of practice analyzed the issues facing patent pledge.The third part analyzes the overseas patent pledge, respectively United States and the United Kingdom and Japan’s specific system and its reference to China.The fourth part under the previously described and analysis, discussion on the development prospects of China’s patent pledge, both for their improvements to the issues raised.Finally,the last word on full-text briefly summarizes,and points out the future study direction.更多还原
