【摘要】 近年来我省社会经济以举世瞩目的速度飞速发展,为加快社会主义市场经济建设、构建社会主义和谐社会,各项民生市政、工业环保、基础设施等工程项目犹如雨后春笋般在我省各地陆续上马。上述的工程项目涉及到土木建设、设备安装、绿化工程、装修工程、日常维护管理等方面,涉及面广、工程量大,有效地带动了我省GDP的持续快速增长。市场容量越来越大,招标投标活动也越来越多。招投标的作用也越来越突出,地位也越来越重要。招投标,是在市场经济条件下,进行大宗货物的买卖、工程建设项目的发包与承包以及服务项目的采购与提供时,所采取的一种交易方式。贿赂犯罪作为职务犯罪的一个分类,是一种性质最为严重的一种腐败形式,是国家工作人员利用职务上的便利进行非法活动,从而侵害了国家机关的管理活动,侵害职务行为的廉洁性,致导使家和人民的利益遭受重大损失,依照刑法应当受到刑罚处罚的犯罪行为。它比一般刑事犯罪具有更强的欺骗性和社会危害性。通过对招投标领域贿赂的查处,全面总结此类犯罪的特点,掌握此类犯罪动向,为进一步查处招投标领域贿赂犯罪提供一定的规律。出于种种原因,近年来,我省招投标领域内的贿赂犯罪现象也大量产生。通过查处此类犯罪总结其犯罪特点,对此领域内时常爆发涉案数额大、牵连人员多、犯罪性质严重、作案手段隐蔽强、社会危害性重的贿赂犯罪,全面剖析其发案的主要原因,大致是体制机制不健全、法律制度不完善、操作执行不到位、标后监管不利等原因。针对招投标领域贿赂犯罪特点以及发案的主要原因,作为检察机关不仅要查处此类犯罪,惩治腐败分子,还要全面掌握其犯罪规律,在为进一步深入查办招投标领域贿赂犯罪方面,提出更加适用、准确的查处对策。在查处犯罪行为的同时,检察机关还有预防犯罪的职能,通过深入剖析招投标领域贿赂犯罪特点及发案原因,总结并提出有针对的预防对策,本文全面的总结了招投标领域贿赂犯罪的八点预防对策和四点查处对策。随着对招标投标领域贿赂犯罪的投诉、举报和立案查处与日俱增。及时有效的做好调查研究,全面归结此类犯罪的特点、客观解析犯罪形成的成因、科学制定相关的预防对策、有效遏制犯罪滋生、促进社会和谐发展已成为司法界共同关注的课题。笔者作为检察机关反贪污贿赂部门的一名工作人员,深感到反腐败的迫切性和重要性,写此文试对招投标领域贿赂犯罪的特点、发案原因等问题进行了深入的分析,并对防治之抒己之浅见。更多还原

And bribery as a category of job-related crimes, is a corrupt form of a most serious nature, the integrity of national staff taking advantage of his position to engage in illegal activities, infringement of the management activities of state organs, infringe on the job behavior, cause the guide so that the interests of the family and the people suffered heavy losses, in accordance with the criminal law should be subject to criminal punishment in criminal behavior. It is more deceptive and harmful to society than the average criminal.
