【摘要】 近年来，随着育种技术以及生物技术的迅猛发展，各种植物品种得到了快速地开发和推广，有关新品种的侵权纠纷也逐年增多，问题层出不穷。然而，由于现有的植物新品种保护适用的法律法规较少，内容不够具体，导致很多法官在审判实践中无所适从，侵权案件难以有效解决。本课题立足于实践，研究了植物新品种侵权纠纷的类型、侵权行为的认定、植物新品种权侵权民事责任的构成要件及其责任承担，围绕实践中存在的疑难问题展开探讨，以期对解决新品种权侵权纠纷提供参考和借鉴。本论文从以下几个方面展开：首先，对植物新品种权侵权问题进行了概述，论述了植物新品种权的相关概念，以明晰植物新品种权要保护的内容，从而解决如何认定植物新品种权侵权的问题。其次，介绍了植物新品种权侵权民事责任的构成要件，认为植物新品种权侵权行为应当以过错责任为主，特殊情况适用无过错责任，得出了让行为人承担财产责任的构成要件，应当符合侵权民事责任的四要件，而让行为人承担非财产责任的构成要件，则无需满足四要件的结论。再次，对植物新品种权侵权的四种民事责任形式即停止侵害、消除影响、赔礼道歉、赔偿损失进行了分析，得出植物新品种权民事责任的构成要件根据其所承担民事责任形式的不同而不同的结论。最后，对植物新品种权侵权的免责事由进行了论述，认为规定免责事由是为了避免品种权人的权利过大，形成行业垄断，同时为了鼓励资源的充分利用。更多还原

【Abstract】 With the rapid development of breeding technology and biotechnology, new varieties ofplants have been fast developed in recent years. Infringement of this kind is increasing yearby year. However, infringement cases can hardly be solved effectively due to the lack oflegal basis. This paper combined the practical case to discuss the difficult problems，suchas,type of plants infringement, identification of the rights infringement, the composition ofthis kind of civil responsibility. Hope these will supply reference for the presentinfringement cases.This paper discusses this aspect as follows. The first part of the article is an overview ofthe new plant variety rights infringement. The concept of new plant varieties and its scope ofprotection are discussed in the first section. The second Section discusses the theories of thenew plant variety rights infringement, especially their specific manifestations. The thirdsection discusses the way to identify new plant variety rights infringement cases and thepaper argues that three essential conditions should be used. The second part of the articlediscusses the Essential Elements of the new plant variety rights infringement. New plantvariety rights violations should be to fault liability, the special circumstances applicable tono-fault liability. Persons are subject to the constituent elements of the property liability shallconform to the four elements of the tort, and let the performer shall bear the responsibility ofthe constituent elements of the non-property, you do not need to be subjective fault of itselements, this section discusses the four elements. The third part of the article discusses thefour civil liability form of the new plant variety rights, that is, stopping encroaching,eliminating the effects, apology and compensation for the loss and the paper reaches theconclusion that the form of civil liability rights is different according to the form of takingthe responsibility.
